NCDOT has previously provided comments to the <br />Town of Hillsborough for a development of a similar name as listed below. <br />Waterstone South (Capkov): <br />• NCDOT has previously reviewed the submitted TIA and provided the attached <br />correspondence <br />• The Applicant will need to obtain the necessary driveway permits and <br />encroachment agreements prior to performing work in the NCDOT R/W <br />• Prior to issuance of permits and encroachments, the Applicant will need to <br />submit complete plans per NCDOT and Town requirements for review and <br />approval. <br /> Planning Date: 3/5/2024 Staff: <br />Taylor Perschau <br />tperschau@orangecountync.gov <br />919-245-2597 <br />1. Application meets the submittal requirements for a major modification to an approved <br />Special Use Permit and is currently on track for a May 8 BOA evidentiary hearing. NIM <br />must be held no later than March 24 in order to maintain that review schedule. <br />2. I recommend the narrative be revised to explicitly say that the requested modification to <br />“the requirement for unitary ownership” is that this condition be removed from the permit. <br />“The requirement for unitary ownership” is referenced as an element being requested for <br />modification, but I don’t find that it’s explicitly detailed as a request that the condition be <br />removed entirely. It is clear that the requested modification for the Open Space is the <br />request that the Open Space be relocated as detailed in the site plan. <br />3. Understanding that this request is being made in connection with a pending application <br />with the Town of Hillsborough, please ensure all materials submitted for review by the <br />Orange County Board of Adjustment clearly outline what Orange County has authority to <br />review. In this case that includes: <br />a. Proposal to remove original SUP requirement for unitary ownership and; <br />b. Proposal to relocate the 25 acres of allocated Open Space. <br />4. Staff recommends maintaining focus on Orange County adopted plans, which includes <br />Central Orange Coordinated Area Land Use Plan (COCA) and Orange County 2030 <br />Comprehensive Plan. Orange County staff and Orange County Board of Adjustment are <br />both tasked to provide review comments and review decision based strictly on Orange <br />County adopted plans and ordinances. As such, staff review will reference the Future <br />Land Use categories designated in the two above referenced plans. <br />5. Town of Hillsborough reference maps (except for those related to the COCA) are not <br />immediately relevant to review comments that Orange County staff or Board of <br />Adjustment can provide. Orange County staff will be clearly communicating to the Board <br />of Adjustment the parameters within which the BOA is tasked to make their review <br />decision. Staff review and BOA decision are to consider the application based on UDO <br />Section 5.3.2 and to apply those standards strictly to the two proposed SUP <br />modifications. <br />6. Question for applicant/Land Records confirmation: is it “ E. Scarlette Mountain Road” or <br />“E. Scarlett Mountain Road?” Whichever is correct should be consistent across all <br />application materials. <br />233
