5. POTENTIAL BOA CONFLICT OF INTEREST STATEMENT <br /> It is the duty of every Board member to avoid both conflicts of interest and appearances <br /> of conflict. Board members having any conflicts of interest or appearances of conflict with <br /> respect to matters before the Board should identify the conflict or appearance of conflict <br /> and refrain from undue participation in the matter involved. <br /> As a reminder, NC General Statute § 160D-109 establishes the following standard: A <br /> member of any board exercising quasi-judicial functions pursuant to this Chapter shall not <br /> participate in or vote on any quasi-judicial matter in a manner that would violate affected <br /> person's constitutional rights to an impartial decision maker. Impermissible violations of <br /> due process include, but are not limited to, a member having a fixed opinion prior to <br /> hearing the matter that is not susceptible to change, undisclosed ex parte <br /> communications, a close familial, business, or other associational relationship with an <br /> affected person, or a financial interest in the outcome of the matter. <br /> 6. CASES: <br /> A-1-24 To review a Special Use Permit request (Case Number <br /> SUP24-0005) submitted by Judea Reform Congregation Cemetery <br /> proposing to operate and expand the existing cemetery (PIN 9767- <br /> 26-1613) on +/- 6.59 acres of a +/- 10.27 acres parcel located at 2560 <br /> Jones Ferry Road, and within the Chapel Hill Township of Orange <br /> County. <br /> A-2-24 — To review Special Use Permit (Case Number SUP24-0006) <br /> request submitted by Capkov Ventures, Inc. proposing a major <br /> modification to previously-approved Special Use Permits for <br /> Woodsedge and The Woods Planned Development Housing <br /> communities (originally approved in 1985 and later modified in <br /> 1991). The request is to modify two SUP conditions regarding <br /> conditions of ownership and the location of Common Open Space. <br /> The site is located on Orange County PINS 9873-41-0172 and 9872- <br /> 49-0872, located south of Phoebe Drive and north of East Scarlett <br /> Mountain Road, and within the Hillsborough and Chapel Hill <br /> Townships of Orange County. <br /> 7. ADJOURNMENT <br />
