135 <br /> 2) the location of the 25 acres of Open Space allocated as part of the 1985 Special Use <br /> Permit and a 1991 modification to that same permit for"Woodesedge", and a 1991 Special <br /> Use Permit for "The Woods". <br /> The 1985 permit, recorded in Orange County Records Book 519 Page 93, and its approved 1991 <br /> modification, Records Book 905 Page 206, were granted for a Planned Development known as <br /> "Woodsedge Mobile Home Park". Concurrent to the 1991 Woodsedge modification, an additional <br /> Special Use Permit was granted for "The Woods Mobile Home Park", Records Book 905 Page <br /> 200. The Woods and Woodsedge effectively operate as a unified mobile home park development. <br /> The approved land use for both permits as a Home Park is not subject to change with this <br /> modification request. The Home Park is a legal non-conforming use in Orange County's <br /> jurisdiction. <br /> The Staff Report (Attachment 2) contains additional information, maps, and staff analysis. <br /> Basic Review Process: Per Section 2.7.14 of the UDO, a request for major modification to a <br /> previously approved Special Use Permit requires submission of an amended site plan and <br /> written narrative outlining the specific changes requested. In accordance with Section 2.7 of the <br /> UDO, the following details the review actions taken on this request: <br /> • FIRST ACTION — Staff Review/Analysis Begins <br /> STAFF COMMENT: An analysis of the application was made by qualified <br /> representatives of the County and other agencies or officials. Attachments 2 and <br /> 5. <br /> • SECOND ACTION — Applicant holds a Neighborhood Information Meeting (NIM). <br /> STAFF COMMENT: The NIM was held on March 21, 2024, at 6:30 p.m., at New <br /> Heart Church of the Nazarene, 3603 NC 86 S., Hillsborough, NC 27278. Meeting <br /> materials are contained in Attachment 3. <br /> • THIRD ACTION — Development Advisory Committee Review/Analysis Begins <br /> STAFF COMMENT: The Orange County Development Advisory Committee <br /> (DAC) met on March 7, 2024, to review this application. The DAC has no <br /> objections to the approval of the major modification to the Special Use Permit so <br /> long as the items in the attached departmental memos (Attachment 5) are <br /> addressed. <br /> • FOURTH ACTION — The Board of Adjustment holds a quasi-judicial hearing, hears <br /> factual evidence and sworn testimony presented at an evidentiary hearing, and then <br /> makes a determination with findings of fact supported by competent, substantial, and <br /> material evidence. <br /> STAFF COMMENT: The evidentiary hearing is anticipated to be held on May 8, <br /> 2024. <br /> A formal application is required as part of a Special Use Permit major modification request and <br /> has been submitted (Attachment 1).
