<br /> CONCLUSIONS OF THE ORANGE COUNTY BOARD OF ADJUSTMENT
<br /> PERTAINING TO A REQUEST SUBMITTED BY
<br /> JUDEA REFORM CONGREGATION CEMETERY CORPORATION
<br /> PROPOSING A CEMETERY
<br /> ON A PARCEL OF PROPERTY LOCATED AT 2560 JONES FERRY ROAD
<br /> (PIN 9767-26-1613)
<br /> When applying the adopted Findings of Fact to the relevant Standards found in the LIDO, the
<br /> Orange County Board of Adjustments makes the following Conclusions:
<br /> 1. All necessary submittal requirements were met, including:
<br /> a. Submittal of proper forms (UDO 2.2, Finding of Fact 1); and,
<br /> b. Fees paid (UDO 2.2.4(D), Finding of Fact 1); and,
<br /> c. The use was fully described (UDO 2.5.3(F) and 2.7.3(B)(1), Finding of Fact 2-6);
<br /> and,
<br /> d. Owner Information was provided (UDO 2.7.3(B)(2), Finding of Fact 1 and 2); and,
<br /> e. The facilities were described (UDO 2.7.3(B)(1), Finding of Fact 2-6); and,
<br /> f. Access, parking, and cemetery use were identified (UDO 2.5.3(F), 2.5.3(L), 5.6.2,
<br /> Finding of Fact 2 and 15); and,
<br /> g. Plans were identified (UDO 2.5.3(K) and 2.7.3(B)(1), Finding of Fact 2 and 15);
<br /> and,
<br /> h. Site plans were submitted, (UDO 2.5, Finding of Fact 2 and 15); and,
<br /> i. A list of parcels within 1,000' was provided (UDO 2.7.3(B)(5), Finding of Fact 2
<br /> and; and,
<br /> j. Environmental Assessment was submitted (LIDO 2.7.3(B)(7), Finding of Fact 2
<br /> and); and,
<br /> k. Method of Debris Removal was described (UDO 2.7.3(B)(8), Finding of Fact 2);
<br /> and,
<br /> I. Development Schedule was provided (UDO 2.7.3(B)(9), Finding of Fact 2), and
<br /> m. Evidence that the requirements of the North Carolina General Statutes Chapter 65
<br /> can be achieved and that the standards of the N.C, Cemetery Commission shall
<br /> be met (LIDO Section 5.6.2(A)(1)(a), Finding of Fact 2 and 7).
<br /> 2. Proper notice was provided as required by statute and ordinance, including:
<br /> a. Notice was mailed for the Neighborhood Information Meeting (UDO 2.7.5(B),
<br /> Finding of Fact 9); and,
<br /> b. Signs were posted for the Neighborhood Information Meeting (UDO 2.7.5(D),
<br /> Finding of Fact 11); and,
<br /> c. Notice was mailed for the Evidentiary Hearing (UDO 2.7.6(A)(1), Finding of Fact
<br /> 10); and,
<br /> d. Signs were posted for the Evidentiary Hearing (UDO 2.7.6(A)(2), Finding of Fact
<br /> 11).
<br /> 3. Waste, Safety and Access requirements were met, including:
<br /> a. The method and adequacy of providing for sewage disposal facilities, solid waste
<br /> and water service is sufficient for the proposed use (UDO 5.3.2(B)(1), Finding of
<br /> Fact 2 and 12); and,
<br /> b. The method and adequacy of police fire and rescue squad protection is sufficient
<br /> for the proposed use (UDO 5.3.2(B)(2), Finding of Fact 2 and 13); and,
<br /> c. The method and adequacy of vehicle access to the site and traffic conditions
<br /> around the site are sufficient for the proposed use (UDO 5.3.2(B)(3), Finding of
<br /> Fact 2 and 14).
<br /> 4. Standards specific to the Cemetery use were met, including:
