130 <br /> Attachment 6b <br /> FINDINGS OF FACT <br /> BY THE ORANGE COUNTY BOARD OF ADJUSTMENT <br /> PERTAINING TO A REQUEST SUBMITTED BY <br /> JUDEA REFORM CONGREGATION CEMETERY CORPORATION <br /> PROPOSING A CEMETERY <br /> ON A PARCEL OF PROPERTY LOCATED AT 2560 JONES FERRY ROAD <br /> (PIN 9767-26-1613) <br /> Based upon the competent, material and substantial evidence received at the evidentiary hearing, <br /> the Board of Adjustments gave each piece of evidence its due weight and makes the following <br /> Findings of Fact: <br /> Application Components <br /> 1. Judea Reform Congregation Cemetery Corporation filed an application for a Special Use <br /> Permit (SUP) related to Orange County PIN 9767-26-1613 on February 16, 2024 for Use <br /> 62(C), Cemetery with a fee paid. <br /> 2. The application included site plans and attachments as included in the agenda materials <br /> received by the BOA, specifically: Attachment 1. <br /> 3. The existing buildings on the property include: The parcel includes an existing shed for <br /> storage which is located outside the designated SUP area. <br /> 4. The proposed buildings include: No structures are proposed. <br /> 5. The access, parking, and cemetery areas include: The project will be utilizing the existing <br /> ingress/egress on Jones Ferry Road. Access throughout the site is proposed with the <br /> extension of the existing 12 — 16 ft. wide gravel driveway. No parking is required for this <br /> use per Section 5.9.7 of the UDO. The proposed cemetery will allow for 784 burial plots. <br /> 6. The landscaping includes: Thirty-foot burial setback along all property lines. Thirty-foot <br /> Type B landscape buffer and street trees are provided along Jones Ferry Road. <br /> 7. Evidence that the requirements of the North Carolina General Statutes Chapter 65 can <br /> be achieved and that the standards of the N.C, Cemetery Commission shall be met: <br /> Cemeteries owned and operated by churches are exempt from standards contained in <br /> Chapter 65 of the North Carolina General Statutes. <br /> 8. Taylor Perschau, a member of the Orange County Planning & Inspections Department <br /> staff, provided sworn testimony regarding receipt of the following: 10 copies of site plans, <br /> a list of parcels within 1,000 feet, 10 copies of Environmental Assessment, method of <br /> debris disposal, and development schedule. <br /> Notice Requirements <br /> 9. Notices of a Neighborhood Information Meeting were mailed on February 27, 2024 by the <br /> applicant and the meeting was held on March 17, 2024. <br /> 10. Notices of the BOA Evidentiary Hearing were mailed on April 23, 2024 and the meeting <br /> held on May 8, 2024. <br /> 11. Signs were posted on February 29, 2024 for the Neighborhood Information Meeting and <br /> on April 24, 2024 for the Evidentiary Hearing. <br /> Waste, Safety & Access <br /> 12. The waste disposal methods were reviewed by Victoria Hudson, Environmental Health <br /> Director with the Orange County Environmental Health Department, and Matthew Taylor, <br /> Environmental Enforcement Supervisor with the Orange County Solid Waste Department. <br /> Neither staff indicated any concern regarding the planned methods. <br />
