11 <br /> 1 Beth Bronson: I understand that completely and I can appreciate. I think it gets back to being present for these meetings and <br /> 2 these volunteer positions just requiring your time. Obviously,we can't anticipate everything that's going to happen, but should there <br /> 3 be a four-fifths vote needed. I feel like we can continue with four. <br /> 4 <br /> 5 James Bryan: You'll have that opportunity each time and you could set that expectation at the beginning with the public. I think <br /> 6 the best course is don't tie your hands unnecessarily with changing this, but that's probably fine to start the meeting and say this is <br /> 7 what we're going to do. We are going to ask you or we're not going to ask you,we're going to do this,we're not going to do this <br /> 8 you know, whatever you want and that probably does save some heartburn rather than telling people at 10:00, you know, what's <br /> 9 going to happen. <br /> 10 <br /> 11 Beth Bronson: And to that point, I think it's onus of the Board to say, I understand what you would request. I'd like to make a <br /> 12 motion that we continue for the reason that we have four here.And then we could make that vote. That's what I'm hearing you say. <br /> 13 Thank you. <br /> 14 <br /> 15 Patrick Mallett: The other context is this Board,we've got seats filled.We struggled to have just the bare minimum filled and then <br /> 16 we had what was sporadic attendance. Quite honestly, I think that this Board does a very good job showing up. Thank you all for the <br /> 17 service. I appreciate that. The people being here matters and everyone that is currently on this Board I think recognizes that, <br /> 18 especially based on recent cases and experience. <br /> 19 <br /> 20 Beth Bronson: And recent attendance rates. It's just very important. If you are a permanent member. I appreciate the discussion, <br /> 21 everybody. It's not that I'm trying to push anything specific, and it's having to do with just making sure that we are all on the same <br /> 22 page. <br /> 23 <br /> 24 Nathan Robinson: It's a good question about the five-member thing,too. <br /> 25 <br /> 26 Beth Bronson: Thank you. <br /> 27 <br /> 28 Leon Meyers: Any other thoughts on that topic before we move on? And I want to pause for a minute. I'm just going to go, but 1 <br /> 29 recognize you in the audience and there may be other folks that are interested in speaking to some of these topics. One of the things <br /> 30 that we haven't yet talked about is the statement of standing form that is going to get some additional attention and that will probably <br /> 31 include a discussion about how that gets disseminated as part of the notice for future cases. And any of you folks care to speak this <br /> 32 evening? Do you have anything that the board needs to hear? <br /> 33 <br /> 34 Matt McDermott: My intent was to have a discussion about obviously the events that took place during the review and ultimate <br /> 35 opinion and vote that was cast regarding Lawrence Road. I will run this question by James because of a concern that may exist is we <br /> 36 are within the appeals time frame, so I'm in a little bit of a dilemma because I am going to provide perspective as I see it regarding <br /> 37 why I thought the procedure was wrong. Will I be allowed to do that with the understanding that the board does not have to respond <br /> 38 to my comments? <br /> 39 <br /> 40 James Bryan: I'll respond. This is a very odd situation. The most Boards of Adjustments do not control their own rules of <br /> 41 procedure. It's usually the governing board that gives them their rules and procedure. You don't normally meet like this, and you <br /> 42 don't normally have members of the public ever address the board. It's within your prerogative, I'm not going to it doesn't give me too <br /> 43 much heartburn but speaking about a case that does, is still pending, does give me a little heartburn that it would be ex parte <br /> 44 communication. <br /> 45 <br /> 46 Matt McDermott: Maybe I'll just suggest that you think about speaking to the board after the time period has, the petition appeal <br /> 47 period has passed? Would that work? I have another idea to the extent it's receptive. It's a prepared statement. I can leave this with <br /> 48 the planning department. You all won't meet again until after the time frame. The appeal time frame is expired on January 5th at <br /> 49 which time I can come back,we can address this or I can come back and we can have a conversation.At a minimum, I would like to <br /> 50 discuss the form of standing and why I think that's missing a vital element. <br /> 51 <br /> 52 Beth Bronson: I would just hesitate against hearing anything about any pending case. And I appreciate that because it's not that <br /> 53 as a member, you know, like we do not want to hear how you feel about our rules or procedures or how, how you would want to <br /> 54 address the commissioners on what they could do or what they could recommend or what the Board of Adjustment could recommend <br /> 55 for changes, right? But in the sense that it may relate to an active case, and even if you only spoke to the rules or procedures. And <br />
