70 <br /> Nest 54 Biological Inventory Report Orange County,N.C. <br /> 49/Main Street in the Town of Haw River. This EO is considered current and was <br /> last observed in 2018. <br /> Cape Fear shiner <br /> USFWS Optimal Survey Window: April-June (tributaries); year-round (large rivers) <br /> Biological Conclusion: No Effect <br /> Stream S2,an Unnamed Tributary(UT)to Cane Creek(tailrace)is the largest creek <br /> within the PSA. This UT is a second order headwater stream that possesses riffle, <br /> run,pool sequences,good substrate sorting, and 0-8"of water depth throughout the <br /> PSA. Water clarity was clear, and volume was slightly above average during the <br /> site visit due to recent precipitation. No definitive fish observations within this UT <br /> were made during the site visit. Additionally, no evidence of freshwater mussels <br /> or Asian clams (Corbicula fluminea)were observed. <br /> One proposed stream crossing of Stream S2 is anticipated at the upper extent of the <br /> reach within the PSA(see preliminary site plan in Appendix B). This is an existing <br /> crossing with two 24" culverts. These culverts are proposed to be replaced in-situ <br /> along with improvements to the existing road corridor. <br /> Typical aquatic species surveys cover 100 meters upstream and 400 meters <br /> downstream of proposed in-stream impact areas in waters determined to possess <br /> suitable habitat for protected species. A point 400 meters downstream of this <br /> proposed crossing is located 75 meters downstream of the PSA boundary. 600 <br /> meters of Stream S2 exists between this"survey end point"and the Stream S2/Cane <br /> Creek confluence. <br /> A review of the Winter (January) 2023 NCNHP dataset indicates no known CFS <br /> EO's within 1.0 mile of the PSA. <br /> If anticipated stream impacts are revised from current preliminary designs and <br /> moved further downstream, surveys for Cape Fear shiner may be warranted if the <br /> downstream survey reach extends into Cane Creek. <br /> Due to the lack of CFS occurrences within 1.0 mile of the PSA, the small size of <br /> the UT, low flow volume, absence of observable fish species during the March 10 <br /> site visit, absence of mussel, clam or snail evidence, as well as the anticipated <br /> minimal impact of replacing existing culverts in place, the Biological Conclusion <br /> rendered for this species is No Effect. <br /> 6 April 2023 <br />
