69 <br /> Nest 54 Biological Inventory Report Orange County,N.C. <br /> 4.0 PROTECTED SPECIES <br /> 4.1 Endangered Species Act Protected Species <br /> The United States Fish and Wildlife Service (USFWS) lists the following federally <br /> protected species within the PSA,under the Endangered Species Act(ESA) (Table 2). For <br /> each species, a discussion of the presence or absence of habitat is included below along <br /> with the Biological Conclusion rendered based on survey results in the PSA. <br /> Table 2. In summer, they <br /> will roost in tree foliage, or sometimes in buildings. They are also known to roost <br /> in bridges and culverts. Suitable foraging habitat includes forested areas and along <br /> creeks. Suitable roosting and foraging habitat for tricolored bat is present within the <br /> PSA. Bridges are absent within the PSA;however,two existing 24" culverts and a <br /> spring house are located on the property. These structures were assessed for <br /> evidence of roosting bats during the March 10th site visit. No evidence of roosting <br /> bats was observed. <br /> Tricolored bat was proposed for listing on September 13, 2022. Generally, species <br /> become listed roughly a year following their proposal for listing. When listed, it is <br /> anticipated that this species will be listed statewide. If tree-clearing activities occur <br /> prior to the species official listing, then no restrictions on tree clearing will be <br /> required. After listing, tree clearing being conducted within the PSA will likely <br /> require seasonal restrictions, such as only being performed between October 16 — <br /> March 31 (i.e., dormant season or winter months) to best avoid potential take of <br /> tricolored bat. Final conservation measure recommendations will be provided by <br /> USFWS once the species is officially listed. <br /> A review of the Winter (January) 2023 North Carolina Natural Heritage Program <br /> (NCNHP) dataset indicates no known tricolored bat Element Occurrence's (EO) <br /> within 1.0 mile of the PSA. The closest EO (EO No. 245; mist net site) is located <br /> 11.5 miles northwest of the PSA, one mile southeast of the Graham Road/NC- <br /> 5 April 2023 <br />
