60 <br /> Orange County Planning & Inspections Department <br /> Special Use Permit Application <br /> Applicant: The Nest at 54 West, LLC <br /> Property: Orange County Parcel 9820-50-8290 <br /> SUP23-0007/Case A-1-23 <br /> Exhibit "E" <br /> Proposed Conditions <br /> 1. The community building shall be used no earlier than 8:00 AM and no later than 8:00 PM, <br /> except by overnight retreat groups, who may utilize the community building with the <br /> presence of a Nest employee until 10:00 PM. <br /> 2. The Property shall observe quiet hours from 10:00 PM to 8:00 AM, during which time there <br /> shall be no outdoor recreation, gathering, socializing, entertainment, or activities <br /> producing noises exceeding 50 dB(A), as measured from the property boundary line. <br /> 3. A live-in on-site host responsible for the management and operation of the Property <br /> outside of normal business hours and during quiet hours may permanently occupy one of <br /> the dwelling units show on the site plan. <br /> 4. The boundaries of the Property will be posted at four (4) equidistant points along the <br /> northern Property line, and at three (3) equidistant points along the eastern Property line. <br /> Signs posted at those points will notify occupants of the Property that leaving the Property <br /> and venturing onto adjoining Property without the express permission or invitation of the <br /> adjoining property owner may result in liability for trespassing or other claims involving the <br /> unpermitted use and/or occupancy of the property of another. <br /> 5. Overnight guests shall be provided with and agree to abide by rules and regulations which <br /> shall include enforceable quiet hours set forth in Voluntary Condition #1 herein above, and <br /> shall prohibit overnight guests from accessing adjoining properties directly from the <br /> Property, among other Property and operation-specific rules and regulations. <br /> 6. The Property shall accommodate no more than 50 overnight guests at any one time in the <br /> provided guest cabins (excluding exempt Special Events held on the Property). <br /> 7. The existing farm road on the Property shall be improved as displayed on the Site Plan. <br /> 8. 25 regular parking spaces and designated areas for up to an additional 20 spaces of <br /> overflow parking shall be provided, as displayed on the Site Plan. <br /> 9. The limits of land disturbance for the Project shall not exceed 4.31 acres as provided on <br /> the Site Plan. <br /> 10. In addition to observance of the required 65-foot stream buffer, the Property shall observe <br /> the voluntary 100-foot stream buffer (except where 5 parking spaces are placed for cabin <br /> guest parking), and all existing natural buffer outside the limits of disturbance shall be <br /> preserved, provided that where any vegetation is removed from the natural buffer, the <br />
