If you do not have an ownership interest in the property what special damages will you <br /> incur if this permit is granted? <br /> NC Courts have ruled that in order to establish standing through "special damages"an individual <br /> must demonstrate by competent, material, and substantial evidence that approving a project will <br /> cause them to suffer a diminution in property value (causes of diminution could be noise, traffic, <br /> etc.). Lay opinion is insufficient by itself to establish a diminution in property value. Only expert <br /> opinion that substantiates a diminution of property value is sufficient. <br /> I intend to submit the following competent, material and substantial evidence to support <br /> my claim of special damages as a qualification for standing to testify in this case. <br /> 3.
