459 <br /> a. The method and adequacy of providing for sewage disposal facilities, solid waste <br /> and water service is sufficient for the proposed use (UDO 5.3.2(B)(1), Finding of <br /> Fact 12); and, <br /> b. The method and adequacy of police fire and rescue squad protection is sufficient <br /> for the proposed use (LIDO 5.3.2(B)(2), Finding of Fact 13); and, <br /> c. The method and adequacy of vehicle access to the site and traffic conditions <br /> around the site are sufficient for the proposed use (UDO 5.3.2(B)(3), Finding of <br /> Fact 14). <br /> 4. Standards specific to the Recreational Facility use were met, including: <br /> a. A proper site plan submitted (UDO 2.5, 2.7.3(B)(4), and 5.7.2(C), Finding of Fact <br /> 2 and 8); and, <br /> b. The lot sizes of 17 and 36 acres are greater than 2 acres (LIDO 5.7.2(A)(2), Finding <br /> of Fact 15); and, <br /> c. The proposed facilities of indoor and outdoor recreation areas, office/storage <br /> space, parking, outdoor concession and restroom facilities are allowed (UDO <br /> 5.7.2(A)(3), Finding of Fact 8 and 16 - 19); and, <br /> d. No building is within 30' of property lines and right-of-ways which is greater than <br /> the use-specific and the district requirements of 20' (UDO 5.7.2(A)(4), Finding of <br /> Fact 17 and 20); and, <br /> e. The outdoor athletic fields comply with the outdoor lighting requirements of the <br /> UDO (6.11) by having the lighting measured as 0.0 footcandles at the property line <br /> and are located at least 51.75'from the property line which is greater than the use- <br /> specific setback of 50' (UDO 5.7.2(A)(5), Finding of Fact 18); and, <br /> f. The 30' development buffer and 40' vegetative buffer are sufficient to keep <br /> equipment on the property (UDO 5.7.2(A)(6) and (C)(2)(d), Finding of Fact 56, 17, <br /> and 19); and, <br /> g. The property has frontage on and access to a public road (Lawrence Rd and US <br /> 70 A) (UDO 5.7.2(C)(2)(a), Finding of Fact 20); and, <br /> h. The lot sizes of 17 and 36 acres are sufficient for both sewage disposal and the <br /> proposed recreational facilities (LIDO 5.7.2(C)(2)(b), Finding of Fact 12 and 21); <br /> and, <br /> i. There are no adverse impacts on the adjacent roads or residential property (UDO <br /> 5.7.2(C)(2)(f), Finding of Fact 14). <br /> 5. General welfare, value and harmony standards applicable to all SUPs have been met, <br /> including: <br /> a. The use will maintain or promote the public health, safety and general welfare, if <br /> located where proposed and developed and operated according to the plan as <br /> submitted (UDO 5.3.2(A)(2)(a), Finding of Fact 22 - 24); and, <br /> b. The use will maintain or enhance the value of contiguous property (UDO <br /> 5.3.2(A)(2)(b), Finding of Fact 22); and, <br /> c. The location and character of the use, if developed according to the plan <br /> submitted, will be in harmony with the area in which it is to be located and the use <br /> is in compliance with the plan for the physical development of the County as <br /> embodied in these regulations or in the Comprehensive Plan, or portion thereof, <br /> adopted by the Board of County Commissioners (UDO 5.3.2(A)(2)(c), Finding of <br /> Fact 23 and 24). <br />
