<br /> CONCLUSIONS OF THE ORANGE COUNTY BOARD OF ADJUSTMENT
<br /> PERTAINING TO A REQUEST SUBMITTED BY
<br /> LAWRENCE ROAD PARTNERS, LLC
<br /> PROPOSING RECREATIONAL FACILITIES
<br /> ON A PARCEL OF PROPERTY OFF OF LAWRENCE ROAD AND US HIGHWAY 70A
<br /> (PIN 9883-19-4355)
<br /> When applying the adopted Findings of Fact to the relevant Standards found in the UDO, the
<br /> Orange County Board of Adjustments makes the following Conclusions:
<br /> 1. All necessary submittal requirements were met, including:
<br /> a. Submittal of proper forms (UDO 2.2, Finding of Fact 1); and,
<br /> b. Fees paid (UDO 2.2.4(D), Finding of Fact 1); and,
<br /> c. The use was fully described (UDO 2.5.3(F) and 2.7.3(B)(1), Finding of Fact 2, 4,
<br /> 5); and,
<br /> d. Owner Information was provided (LIDO 2.7.3(B)(2), Finding of Fact 1); and,
<br /> e. The facilities were described (LIDO 2.7.3(B)(1) and 5.7.2(C)(1)(a), Finding of Fact
<br /> 4); and,
<br /> f. Access, parking, service and recreation areas were identified (LIDO 2.5.3(F),
<br /> 2.5.3(L), and 5.7.2(C)(1)(b), Finding of Fact 5); and,
<br /> g. Plans and elevations were identified (LIDO 2.5.3(K), 5.7.2(C)(1)(c), and
<br /> 2.7.3(B)(1), Finding of Fact 2, 4, and 8); and,
<br /> h. Landscape plans were provided (LIDO 2.5.3(P), 5.7.2(C)(1)(d) and 6.8, Finding of
<br /> Fact 6); and,
<br /> i. Signed statement was submitted on adverse effects and list of activities (LIDO
<br /> 5.7.2(C)(1)(e), Finding of Fact 7); and,
<br /> j. Site plans were submitted, (UDO 2.5, Finding of Fact 2 and 8); and,
<br /> k. A list of parcels within 1,000' was provided (LIDO 2.7.3(B)(5), Finding of Fact 2 and
<br /> 8); and,
<br /> I. Elevations were provided (UDO 2.7.3(B)(6), Finding of Fact 2 and 8); and,
<br /> m. Environmental Assessment was submitted (LIDO 2.7.3(B)(7), Finding of Fact 2
<br /> and 8); and,
<br /> n. Method of Debris Removal was described (UDO 2.7.3(B)(8), Finding of Fact 2 and
<br /> 8); and,
<br /> o. Development Schedule was provided (UDO 2.7.3(B)(9), Finding of Fact 2 and 8;
<br /> and,
<br /> p. Extended Vesting Requirement was included (UDO 2.5.5, 2.7.3(10), 2.7.11(D),
<br /> and 2.7.13(E), Finding of Fact 2 and 8).
<br /> 2. Proper notice was provided as required by statute and ordinance, including:
<br /> a. Notice was mailed for the Neighborhood Information Meeting (LIDO 2.7.5(B) and
<br /> (C), Finding of Fact 9); and,
<br /> b. Signs were posted for the Neighborhood Information Meeting (UDO 2.7.5(D),
<br /> Finding of Fact 11); and,
<br /> c. Notice was mailed for the Evidentiary Hearing (LIDO 2.7.6(A)(1), Finding of Fact
<br /> 10); and,
<br /> d. Signs were posted for the Evidentiary Hearing (UDO 2.7.6(A)(2), Finding of Fact
<br /> 11).
<br /> 3. Waste, Safety and Access requirements were met, including:
