457 <br /> 10. Notices of the BOA Evidentiary Hearing were mailed on October 3, 2023 and the meeting <br /> held on October 18, 2023. <br /> 11. Signs were posted on August 1, 2023 for the Neighborhood Information Meeting and on <br /> October 4, 2023 for the Evidentiary Hearing. <br /> Waste, Safety & Access <br /> 12. The waste disposal methods were reviewed by Victoria Hudson, Environmental Health <br /> Director with the Orange County Environmental Health Department, and Matthew Taylor, <br /> Environmental Enforcement Supervisor with the Orange County Solid Waste Department. <br /> Neither staff indicated any concern regarding the planned methods. <br /> 13. The method of police, fire and rescue squad protection were reviewed by Elizabeth <br /> Farnan, Fire and Life Safety Chief with the Orange County Fire Marshall's Office. There <br /> was no indication of concern. <br /> 14. The method of vehicle access was reviewed by NCDOT District Office and indicated no <br /> concerns. <br /> Recreational Facilities <br /> 15. The lot size is: +/- 84.9 acres, +/-53.37 acres are subject to the Special Use Permit for <br /> Use #38 Recreational Facilities. <br /> 16. The facilities include: an indoor recreational facility for tennis, pickleball, basketball, <br /> volleyball, and other recreational activities; outdoor tennis or pickleball courts; and outdoor <br /> fields for softball and baseball activities. <br /> 17. The closest building to a right-of-way or property line is: the indoor recreation facility and <br /> is buffered by a 30' development perimeter buffer which is to be supplemented by Type C <br /> Landscape Buffer vegetative plantings. The final building setback is not available as the <br /> elevations submitted are conceptual. The building will meet the minimum required <br /> setbacks established for the R-1 district. <br /> 18. The closest athletic field to a property line is: 51.75' from the southern property line. <br /> 19. The outdoor recreational facilities will use a combination of screens, fences, nets, berms <br /> or vegetation to keep equipment on the property. <br /> 20. The property has frontage on and access to a public road, namely: Lawrence Road and <br /> US 70A. <br /> 21. The water and wastewater systems are: private well and septic systems, the components <br /> of which are wholly contained within the subject parcel. <br /> General Welfare, Value & Harmony <br /> 22. The expected value difference with the proposed use for contiguous property is: as <br /> presented and entered as evidence on the evening of the evidentiary hearing. <br /> 23. The location and character of the use is: if developed according to the plan submitted and <br /> in accordance with the conditions, the project will be in general harmony with the <br /> surrounding area and the use would be in compliance with the plan for the physical <br /> development of the County as embodied in the Unified Development Ordinance or in the <br /> Comprehensive Plan, or portion thereof, adopted by the Board of County Commissioners. <br /> 24. The character of the area in which the use is located is: medium and low-density <br /> residential with some recreational and commercial activity nearby. <br />
