456 <br /> FINDINGS OF FACT <br /> BY THE ORANGE COUNTY BOARD OF ADJUSTMENT <br /> PERTAINING TO A REQUEST SUBMITTED BY <br /> LAWRENCE ROAD PARTNERS, LLC <br /> PROPOSING RECREATIONAL FACILITIES <br /> ON A PARCEL OF PROPERTY OFF OF LAWRENCE ROAD AND US HIGHWAY 70A <br /> (PIN 9883-19-4355) <br /> Based upon the competent, material and substantial evidence received at the evidentiary hearing, <br /> the Board of Adjustments gave each piece of evidence its due weight and makes the following <br /> Findings of Fact: <br /> Application Components <br /> 1. Lawrence Road Partners LLC. filed an application for a Special Use Permit related to <br /> Orange County PIN 9883-19-4355 on July 19, 2023 for Use 38, Recreational Facilities <br /> with a fee paid. <br /> 2. The application included site plans and attachments as included in the agenda materials <br /> received by the BOA, specifically: Attachment 1. <br /> 3. The existing buildings on the property include: there are no existing buildings on the <br /> property. <br /> 4. The proposed buildings include: an approximately 61,400 square foot indoor recreation <br /> facility and 12 outdoor tennis or pickleball courts on Lot 1. The development further <br /> proposes 4 outbuildings on Lot 2 to serve as concessions, bathrooms, and picnic facilities. <br /> The baseball fields and recreation facility each expect early member estimates to be <br /> between 250-300 members. Maximum members of these facilities shall be about 600 <br /> members. <br /> 5. The access, parking, service and recreation areas for all facilities include: a shared internal <br /> access drive with connection to Lawrence Road on the west of the site and connection to <br /> US 70A on the north of the site. Lot 1 features a total of 136 parking spaces for the tennis <br /> or pickleball courts and indoor recreation facility. Lot 2 features a total of 188 parking <br /> spaces for the baseball fields. <br /> 6. The landscaping includes: a 30' development perimeter buffer to be supplemented with <br /> Type C Landscape Buffer plantings. Street trees are to be provided along the internal <br /> drive. A 5' foundation planting strip will surround the perimeter of the indoor recreation <br /> facility. Perimeter buffers and interior landscaping will be provided in vehicle use areas in <br /> accordance with UDO Section 6.8. <br /> 7. Lawrence Road Partners, LLC submitted a signed statement regarding adverse effects <br /> and listing the following as the complete list of activities: baseball games, practices, and <br /> events; softball games, practices, and events; tennis games, classes, tournaments, and <br /> camps; pickleball games, classes, tournaments, and camps; indoor recreation including <br /> basketball, volleyball, tennis, and other indoor activities; outdoor sports and games; indoor <br /> sports and games. <br /> 8. Taylor Perschau, a member of the Orange County Planning & Inspections Department <br /> staff, provided sworn testimony regarding receipt of the following: 10 copies of site plans, <br /> a list of parcels within 1,000 feet, elevations, 10 copies of Environmental Assessment, <br /> method of debris disposal, development schedule, extended vesting schedule. <br /> Notice Requirements <br /> 9. Notices of a Neighborhood Information Meeting were mailed on July 31, 2023 by the <br /> applicant and the meeting was held on August 15, 2023. <br />
