367 <br /> Proposed Project <br /> Proposed Development <br /> Lawrence Road Partners, LLC, property owner and applicant, is requesting a Special Use Permit for <br /> Lawrence Road Development, herein after"the "project," for Recreational Facilities use (Use #38, Table of <br /> Permitted Uses) on +/-53.37 acres of the +/-84.9 acres property. As detailed within the application and site <br /> plan, Lot 1 of the project is proposed to feature outdoor recreation courts for tennis and pickleball and <br /> indoor courts for tennis, pickleball, basketball, and volleyball. Lot 2 of the project is proposed to feature <br /> outdoor baseball and softball fields, and facilities for bathrooms and concessions. The portion of the parcel <br /> designated as Lot A is not subject to the Special Use Permit request. For the purposes of land disturbance <br /> Lots 1 and 2 are to be considered a common project of development with the disturbances being <br /> cumulative, regardless of the phase, use, or occupants; Lot A will be developed separately. <br /> The project proposes two points of ingress/egress, one on Lawrence Road and one on US Highway 70A. <br /> Internal driveways will be lined with sidewalks. Sidewalks will also be provided along the property's street <br /> frontage outside of the public right-of-way. All sidewalks will be privately-maintained and an easement will <br /> be provided to allow public access to these sidewalks. Parking will be available in multiple surface lots. <br /> Both recreational facilities have established hours of operation to be 8am to 10pm, 7 days a week; this is <br /> detailed in the site plan and conditions of approval submitted by the applicant. Outdoor recreational play will <br /> stop at 9pm for cleanup and maintenance. The project will not include a public address system. Outdoor <br /> lighting is proposed for the baseball fields and "lower courts" of the outdoor tennis facility; a lighting plan <br /> was submitted as part of the application (Attachment 1). <br /> Additionally, the project has requested a vesting period of 5 years, as allowed by Sections 2.5.5 and 2.7.13 <br /> of the Orange County UDO and NC General Statutes 160D-108. <br /> The Orange County Unified Development Ordinance (UDO) Table of Permitted Uses (Article 5, Section 2) <br /> allows for"Recreational Facilities" to be permitted as a Special Use in the Rural Residential (R-1) zoning <br /> district, subject to use standards and conditions of approval, including a site plan approved by the Orange <br /> County Board of Adjustment. <br />
