STATEMENT OF APPROVAL AND CONSISTENCY OF <br />A PROPOSED UNIFIED DEVELOPMENT ORDINANCE TEXT AMENDMENT WITH <br />ADOPTED ORANGE COUNTY PLANS <br />Orange County has initiated an amendment to the Unified Development Ordinance (UDO) to <br />respond to and comply with NC Session Laws 23-108 and -137. <br />The Planning Board hereby recommends approval of the proposed text amendment and issues <br />this Statement of Consistency pursuant to NCGS § 160D-604 (d) Planning board review and <br />comments – Plan consistency. The Planning Board finds: <br />1. The requirements of UDO Section 2.8 Zoning Atlas and Unified Development <br />Ordinance Amendments, including review by the Development Advisory Committee <br />(DAC), as required in UDO Section 1.9, have been met; <br />2.The amendment is consistent with the adopted 2030 Orange County Comprehensive Plan, <br />as prescribed by UDO Section 1.1.5 Statement of Intent – Amendments and Section 1.1.7 <br />Conformance with Adopted Plans, and will “correct a manifest error in the Ordinance”; <br />3. The amendment is generally inconsistent with the goals and objectives of the 2030 <br />Comprehensive Plan, but is compliant with adopted State laws, and does support the <br />following objectives in the 2030 Comprehensive Plan: <br />a.Land Use Objective LU-4.2: Review and amend the Orange County Unified <br />Development Ordinance to identify and eliminate existing regulatory <br />impediments to objectives identified in the Comprehensive Plan. Such objectives <br />include but are not limited to the development of energy efficient buildings within <br />the County, water efficiency standards for new development, and development of <br />affordable housing. <br />b.Housing Objective H-4.4: Working collaboratively with the towns, identify <br />regulatory barriers to be removed and opportunities for development incentives to <br />encourage the construction of a diverse range of housing types countywide. <br />4.The amendment is consistent with this principle and these goals because implementation <br />will result in more redevelopment options for redevelopment projects in Orange County. <br />5. The amendment is reasonable and in the public interest because it brings the County’s <br />development standards into compliance with North Carolina State laws. <br />The Planning Board hereby adopts this Statement of Approval and Consistency and the <br />findings expressed herein. <br />Attachment 3 <br />104
