FY 2025 Special Section 5333(b) <br /> Warranty <br /> PURPOSE: To approve the Federal Certifications & Assurances and other documents required <br /> by the Federal Transit Administration (FTA) for Orange County transit. <br /> BACKGROUND: Each year, the Federal Transit Administration (FTA) is authorized to consolidate <br /> the Certifications and Assurances required by federal law or regulations. The Fiscal Year (FY) <br /> 2024 Federal Certifications & Assurances (Attachment 1) were recently released for local <br /> approval. The Federal FY is from October to September, while the State FY is from July to June. <br /> Orange County Transportation Services last updated the County's transit Federal Certification and <br /> Assurances in March 2022 for FY 2023. Staff will update these on an annual basis going forward, <br /> along with the following Fiscal Year (Attachments 2 — 4) documents as required by FTA <br /> Orange County Public Transit, as an applicant for Federal Transit program grant assistance, must <br /> submit to FTA annually a list of all Certifications and Assurances that must be made by applicants <br /> to its financial assistance programs (49 U.S.C. 5323(n)). The attachments contain the <br /> Certifications and Assurances that apply. <br /> Funding applicants must certify every category that applies to both the applicant and the <br /> applications submitted in the fiscal year or certify all activities at once. FTA will not enforce <br /> provisions of a certification that do not apply to the applicant or award. <br /> In addition to the Federal Certifications and Assurances, the FY 2025 application package also <br /> requires State certifications. Included in the State package are the Certifications and Restrictions <br /> on Lobbying, Special Section 5333(b) Warranty, and the Certification of Equivalent Service <br /> applicable when 1) purchasing a non-lift equipped vehicle, or 2) a fleet includes non-lift equipped <br /> vehicles. The Certification of Equivalent Service does not apply to applicants who do not have a <br /> fleet of vehicles. <br />
