20 <br /> Certifications and Assurances Fiscal Year 2024 <br /> CATEGORY 19. CYBERSECURITY CERTIFICATION FOR RAIL ROLLING STOCK <br /> AND OPERATIONS. <br /> If the applicant operates a rail fixed guideway public transportation system, it must make this <br /> certification. This certification is required by 49 U.S.C. §5323(x). For information about <br /> standards or practices that may apply to a rail fixed guideway public transportation system, visit <br /> https://www.nist.gov/cyberframework and https://www.cisa.gov/. <br /> The applicant certifies that it has established a process to develop, maintain, and execute a <br /> written plan for identifying and reducing cybersecurity risks that complies with the requirements <br /> of 49 U.S.C. § 5323(v)(2). <br /> CATEGORY 20. PUBLIC TRANSPORTATION ON INDIAN RESERVATIONS <br /> FORMULA AND DISCRETIONARY PROGRAM(TRIBAL TRANSIT <br /> PROGRAMS). <br /> Before FTA may provide Federal assistance for an Award financed under either the Public <br /> Transportation on Indian Reservations Formula or Discretionary Program authorized under <br /> 49 U.S.C. §5311(c)(1), as amended by the FAST Act, (Tribal Transit Programs), the applicant <br /> must select the Certifications in Category 21, except as FTA determines otherwise in writing. <br /> Tribal Transit Program applicants may certify to this Category and Category I (Certifications <br /> and Assurances Required of Every Applicant) and need not make any other certification, to meet <br /> Tribal Transit Program certification requirements. If an applicant will apply for any program in <br /> addition to the Tribal Transit Program, additional certifications may be required. <br /> FTA has established terms and conditions for Tribal Transit Program grants financed with <br /> Federal assistance appropriated or made available under 49 U.S.C. § 531l(c)(1). The applicant <br /> certifies that: <br /> (a) It has or will have the legal, financial, and technical capacity to carry out its Award, <br /> including the safety and security aspects of that Award. <br /> (b) It has or will have satisfactory continuing control over the use of its equipment and <br /> facilities acquired or improved under its Award. <br /> (c) It will maintain its equipment and facilities acquired or improved under its Award, in <br /> accordance with its transit asset management plan and consistent with FTA regulations, <br /> "Transit Asset Management,"49 CFR Part 625.
