18 <br /> Certifications and Assurances Fiscal Year 2024 <br /> If the applicant operates a rail fixed guideway service, the applicant certifies that, in the fiscal <br /> year for which an award is available to the applicant under the State of Good Repair Grants <br /> Program, 49 U.S.C. § 5337, the applicant will not award any contract or subcontract for the <br /> procurement of rail rolling stock for use in public transportation with a rail rolling stock <br /> manufacturer described in 49 U.S.C. § 5323(u)(1). <br /> CATEGORY 14. INFRASTRUCTURE FINANCE PROGRAMS. <br /> If the applicant will apply for an award for a project that will include assistance under the <br /> Transportation Infrastructure Finance and Innovation Act("T/FIA') Program (23 U.S.C. <br /> §§ 601-609) or the State Infrastructure Banks ("SIB')Program (23 U.S.C. §610), it must make <br /> the certifications in Category 8 for the Urbanized Area Formula Grants Program, Category 10 <br /> for the Fixed Guideway Capital Investment Grants program, and Category 13 for the State of <br /> Good Repair Grants program. These certifications are required by 49 U.S.C. §5323(o). <br /> Making this certification will incorporate the certifications in Categories 8, 10, and 13 by <br /> reference. <br /> CATEGORY 15. ALCOHOL AND CONTROLLED SUBSTANCES TESTING. <br /> If the applicant will apply for an award under FTA's Urbanized Area Formula Grants Program <br /> (49 U.S.C. §5307), Fixed Guideway Capital Investment Program (49 U.S.C. §5309), Formula <br /> Grants for Rural Areas Program (49 U.S.C. §5311), or Grants for Buses and Bus Facilities <br /> Program (49 U.S.C. §5339)programs, the applicant must make the following certification. The <br /> applicant must make this certification on its own behalf and on behalf of its subrecipients and <br /> contractors. This certification is required by 49 CFR§ 655.83. <br /> The applicant certifies that it, its subrecipients, and its contractors are compliant with FTA's <br /> regulation for the Prevention of Alcohol Misuse and Prohibited Drug Use in Transit Operations, <br /> 49 CFR Part 655. <br /> CATEGORY 16. RAIL SAFETY TRAINING AND OVERSIGHT. <br /> If the applicant is a State with at least one rail fixed guideway system, or is a State Safety <br /> Oversight Agency, or operates a rail fixed guideway system, it must make the following <br /> certification. The elements of this certification are required by 49 CFR§§ 672.31 and 674.39. <br /> The applicant certifies that the rail fixed guideway public transportation system and the State <br /> Safety Oversight Agency for the State are: <br /> (a) Compliant with the requirements of 49 CFR Part 672, "Public Transportation Safety <br /> Certification Training Program"; and <br /> (b) Compliant with the requirements of 49 CFR Part 674, "Sate Safety Oversight". <br /> 16 <br />
