2 <br /> There are many conditions within the County SUP that exhibit the close coordination with <br /> Hillsborough on many issues of utilities and architecture. <br /> Also pursuant to annexation law, the annexing municipality would have to prepare a report <br /> on the feasibility of providing the project with public services. A letter from Eric Peterson <br /> (June 6) and Town Board discussion on June 10 found that Hillsborough does not have <br /> enough information to conduct an analysis at this time and since the project would be a <br /> satellite annexation, there.would be question whether the project would exceed the town's <br /> percentage limits of satellite annexation. <br /> If annexation does occur pursuant to Section 160A-45-49, the undeveloped land within the <br /> previous county Planned Development (PD) and SUP would be subject to the laws and <br /> ordinances (including zoning)of the municipality. In other words, the County zoning <br /> authority and SUP conditions would be expunged and be replaced by a new duly enacted <br /> zoning designation from Hillsborough. Hillsborough would process and approve how the <br /> remainder of the undeveloped land would be built: <br /> In summary, the options from the developer to change conditions have been forwarded <br /> from the county in the form of a letter dated May 22. This available amendment process <br /> may have prompted the letter of June 4 by the developer to Hillsborough requesting <br /> annexation to forego county zoning/SUP conditions. At this time, Hillsborough cannot act <br /> on the request until more development information is given and suggested dialogue <br /> between county/town commissioners is achieved. <br /> 3. OSBORN RESPONSE <br /> Ms, Susan Osborn, a resident of Churton Grove, had questions concerning the timing and <br /> construction of the pool/clubhouse and what help/requirements the County could impose <br /> on the development. The attached material outlines the responses. <br /> FINANCIAL IMPACT: None at this time. <br /> RECOMMENDATION(S): The Manager recommends that the Board receive the report. <br />
