~~~ <br />AN ORDINANCE AMENDING <br />THE JOINT PLANNING AGREEMENT <br />WHEREAS, Orange County and the Towns of Chapel Hill and Carrboro entered into a <br />Joint Planning Agreement, dated September 22, 1987, as amended April 2, 1990, <br />September 30, 1998, February 2, 1999, August 20, 2002, and June 24, 2003; and <br />WHEREAS, Exhibit A to the Joint Planning Agreement, the Joint Planning Area Land <br />Use Map, depicts Transition Areas (thdse in transition from n~ral to urban or already <br />urban in density) and the Rural Buffer (an area that is rural in character and which will <br />remain rural, contain low-density residential uses and not require urban services); and <br />WHEREAS, the area bounded by Chatham County to the south, US 15/501 to the west, <br />the Chapel Hill Extraterritorial Jurisdiction (ETJ) to the north, and Old Lystra Road to the <br />east and known as the Chapel Hill Southern Transition Area has been removed from <br />the Urban Services Area; and <br />WHEREAS, the designation of Rural Buffer is now more appropriate for this area. <br />NOW THEREFORE, THE ORANGE COUNTY BOARD OF COMMISSIONERS, <br />CHAPEL HILL TOWN COUNCIL, AND CARRBORO BOARD OF ALDERMEN <br />HEREBY RESOLVE THAT EXHIBIT A TO THE JOINT PLANNING AGREEMENT BE <br />AMENDED AS FOLLOWS: <br />That the area bounded by Chatham County to the south, US 15/501 to the west, <br />the Chapel Hill Extraterritorial Jurisdiction (ETJ) to the north, and Old Lystra <br />Road to the east depicted as Transition shall be changed to Rural Buffer. <br />The area to be re-designated is indicated on the attached map. <br />This ordinance shall become effective upon adoption by the governing bodies of <br />Orange County and the Towns of Chapel Hill and Carrboro. <br />G:\Comprchensivc Planning Div\GENE\2004 Public HearingsNlar 29 7PAV.ndt m 7P Agrcement\Amdt to JP Aymnt ]t StaffMcmo doc ,r <br />
