~`0 AN ORDINANCE AMENDING THE ORANGE COUNTY ZONING ATLAS WHEREAS, Orange County and the Towns of Chapel Hill and Carrboro entered into a Joint Planning Agreement, dated September 22, 1987, as amended April 2, 1990, September 30, 1998, February 2, 1999, August 20, 2002, and June 24, 2003; and WHEREAS, a Joint Planning Area Land Use Plan was jointly prepared and adopted by all parties to the agreement; and WHEREAS, the area in the Plan bounded by Chatham County to the south, US 15/501 to the west, the Chapel Hill Extraterritorial Jurisdiction (ETJ) to the north, and Old Lystra Road to the east and known as the Chapel Hill Southern Transition Area was originally intended to receive urban-scale development; and WHEREAS, this area was rezoned to the Chapel Hill R-LD1 zoning district in 1993 in accordance with the Joint Planning Agreement WHEREAS, the Chapel Hill Southern Transition Area has been removed from the Urban Services Area and the area amended to Rural Buffer in the Joint Planning Area Land Use Plan by the Carrboro Board of Aldermen, Chapel Hill Town Council, and Orange County Board of Commissioners; and WHEREAS, to achieve consistency with the Joint Planning Area Land Use Plan, the Orange County Rural Buffer zoning district is appropriate for this area. NOW THEREFORE, THE ORANGE COUNTY BOARD OF COMMISSIONERS HEREBY RESOLVE: That the zoning classification of fhe area bounded by Chatham County to the south, US 15/501 to the west, the Chapel Hill Extraterritorial Jurisdiction (ETJ) to the north, and Old Lystra Road to the east is hereby changed to the Orange County Rural Buffer district. The area to be re-zoned is indicated on the attached map, This ordinance shall become effective upon adoption by the Orange County Board of Commissioners.
