342 <br />Memorandum of Understanding <br />Between The Local Mental Health Authority <br />And The North Carolina Department of Mental Health <br />ORANGE COUNTY MENTAL HEALTH AUTHORITY. <br />The 1963 North Carolina General Assembly passed an act creating a State Department of Mental Health <br />and State Hoard of Mental Health (G. S. 122-1.0 and 1.1), thus consolidating state mental health <br />responsibilities in one agency. <br />This act provides an organizational framework for the cooperation, coordination, and <br />direction of existing services and programs: local mental health services; state <br />mental hospitals and residential centers for the retarded; special programs for <br />alcoholics and emotionally disturbed children; licensing of private psychiatric <br />facilities; research and education in mental, health. The purpose of this act is <br />to assure maximum benefits to the people from state and local resources in mental <br />health. <br />The act enables the Department of Mental Health and local governmental or non- <br />governmental agencies to establish by partnership agreement mental health services in <br />communities which are willing to participate. This memorandum is the partnership <br />arrangement, the Department of Mental Health representing the State of North Carolina <br />and the local mental health aughority representing the community. <br />1. By May 15 of each year the local mental health authority shall submit to the State Department of <br />Mental Health a plan and proposed budget for approval for the operation of a clinic or program <br />for the ensuing distal year. The plan shoulc include an outline of immediate and, when feasible, <br />future plans for the development of mental health services, considering all mental health issues <br />within the total community and. encompassing all relevant individuals, agencies, and orgaiiizations <br />which have mental health concerns or mental health resources for action. The budget should include <br />a detailed itemized account of proposed expenditures for all operating costs with a clear descrip- <br />tion of expected sources of funds. <br />II. Grants-in-aid: After approval of the application, the State Department of Mental Health will <br />provide funds, contingent on sufficient appropriations, on the following formula: two-thirds of <br />the first $30,000 of the total operating budget and one-half of the remaining operating budget. <br />(G. S. 122-35.12). Actual expenditures will be the basis of deterfidning grants-in-aid when <br />such expenditures are less than the approved budget. Quarterly payments to the local mental <br />health authority will be made on the basis of expenditures as shown in preceding monthly reports. <br />II. All procedures regarding the establishment and operation of mental health services are prescribed <br />by regulation of the State Board of Mental Health (G. S. 122-35.5 and.7). <br />IV. At the time of the establishment of a mental health clinic, a clinical director (licensed physician <br />with psychiatric training and experience) will be appointed by the local mental health authority <br />with the approval of the Commissioner of Mental Health (G. S. 122-35.7). Personnel will be <br />employed in accordance with provisions of the North Carolina Merit System. <br />V. The collection of fees (G. S. 122-35.10) for services performed in a child guidance clinic shall <br />be optional. Fees shall be collected from adults accented for services who are albe to pay. No <br />person is to be refused service because of inability to pay. Fees are to be fixed by the local <br />mental health authority, and funds so collected shall be need for the fiscal operation of local <br />mental health services; such funds may be used to match state funds. <br />T2. The local mental health authority shall be responsible for obtaining necessary local funds for <br />support of local mental health services (G. S. 122-35.11). <br />We are in agreement with the above description of responsibilities and relationships. This <br />amorandum of understanding may be reviewed at any time but shall be reviewed once each four years. <br />Upon motion of Commissioner Smith, seconded by Commissioner Cleveland, and unanimously <br />adopted, the•following Proclamation was issued: <br />PROCLAMATION DESIGNATING INDUSTRY APPRECIATION WEEK <br />WHEREAS, the industries of Orange County make a substantial contribution to the <br />economic well being of the county, by employing citizens of the county, by buying <br />items grown or produced in the county, and by paying taxes to help support county <br />services, and <br />WHEREAS, the efforts. to encourage the location of additional industry in the <br />county at times may appear to overshadow the contributions now being made by existing <br />industries; and <br />WHEMQ,Terry Sanford, Governor of North Carolina, has designated the week of <br />April 12 to 18, 1964 as Industry Appreciation Week throughout North Carolina; <br />NOW THEREFORE BE IT PROCLAIMED by the Hoard of County Commissioners of Orange <br />County, North Carolina, that the week of Auril 12 to 18, 1964 be Industry Appreciation <br />Week in Orange County, thereby providing an opportunity for all officials and <br />citizens to express appreciation for the great contribution made by industry to the <br />county.
