3 <br /> MEMORANDUM <br /> TO: County Commissioners <br /> COPIES: John Link, County Manager <br /> Geof Gledhill,County Attorney <br /> FROM: Paul Thames, PE, County Engineer <br /> DATE: June 18, 2002 <br /> SUBJECT: Sewer tap requested by Roy McAdoo of Efland <br /> As per the request of the BOCC, for a report related to providing a sewer tap from the Efland sewer <br /> system to property belonging to Roy McAdoo and his family,the following information is provided. <br /> Over the past several years Mr. McAdoo has been in contact with County staff on several occasions <br /> about acquiring a sewer tap for a property belonging to him and his family(William R. McAdoo heirs <br /> property) on Fuller Street in Efland. It has generally been Mr.McAdoo's contention that the County <br /> should have installed a tap for this property when the Efland sewer system was originally constructed in <br /> 1987/88,but unaccountably failed to do so. <br /> Mr. McAdoo has been advised that, according to the resolutions and rules adopted by the BOCC during <br /> the creation of the Efland sewer system, each property owner desiring a free tap onto the system was <br /> required to sign a document requesting that tap during the customer sign-up process that took place in <br /> 1985. He was also advised that County staff have been unable to find evidence that such a document <br /> ever existed for this particular parcel(tax map number 3.32.13.11). Mr.McAdoo has likewise been <br /> unable to produce such a document. Mr. McAdoo has produced a number of documents related to <br /> condemnation process utilized by the County to acquire an easement across the front of the property for <br /> the purpose of installing the sewer main in Fuller Street(the property lines went to the center of Fuller <br /> Street and beyond,requiring that the County acquire an easement even though the line was installed in <br /> the center of the street). <br /> It appears that Mr. McAdoo's primary contention is that a member of County staff or a community <br /> volunteer working on behalf of the County during the Efland sewer sign-up process in 1985 failed to <br /> properly advise the McAdoo family as to the necessities of sign-up process or otherwise failed to have a <br /> sewer request document executed by the heirs. Accordingly,Mr. McAdoo contends that the property <br /> should now receive a sewer tap at no cost since the County's error led to the tap not being installed <br /> during the sewer construction process. <br /> The piece of property in question is 2.6 acres according to the County's tax data. Under the existing tap <br /> fee structure, the cost of a tap would be approximately$6500,broken down as follows: $2475 Town of <br /> Hillsborough tap fee; 2.6 acres at$1000 per acre plus$600 per tap fee(total $3200)to Orange County; <br /> and$825 to construct the tap itself <br /> If I may provide additional information, please advise. <br />
