87 Restrictions on Illumination <br />a) Unless otherwise prohibited by this chapter, signs may be illuminated if such <br />illumination is in accordance with this Section. <br />b) No sign within one hundred fifty (150) feet of a residential zone may be <br />illuminated between the hours of 12 midnight and 6:00 am, unless the impact of <br />such lighting beyond the boundaries of the lot where it is located is entirely <br />inconsequential. <br />C) Lighting directed toward a sign shall be shielded so that it illuminates on the face <br />of the sign and does not shine directly into a public right -of -way or residential <br />premises. <br />d) Internally illuminated suns may not be illuminated during the hours that the <br />business or enterprise advertised by such sign is not open for business or in <br />operation. Notwithstanding any other provision of this Ordinance, existing <br />situations that violate the provisions of this subsection shall not be regarded as <br />lawful, non - conforming situations. <br />e) Subject to subsection (g), illuminated tubing or strings of lights that outline <br />property lines, sales areas, roof lines, doors, windows, or similar areas are <br />prohibited. <br />f) Subject to subsection (g), no sign may contain or be illuminated by flashing or <br />intermittent lights or lights of changing degrees of intensity, except signs <br />indicating the time, date, or weather conditions <br />g) Subsections (e) and (0 do not apply to temporary signs erected in connection with <br />observance of holidays. <br />h) Within the CC district, neon signs shall not be permitted For purposes of this <br />subsection, the term "neon sign" includes all signs in which illuminated tubing <br />constitutes or forms all or part of the message of the sign, as well as signs in <br />which the message area of the sign is outlined, underlined, or otherwise <br />highlighted by illuminated tubing <br />8.8 Determining the Number of Signs <br />For the purpose of determining the number of sips permitted, a sign shall be considered <br />to be a single display device containing elements organized, related, and composed to <br />form a unit, <br />Without limiting the generality of the above, a multi -sided sign shall be regarded as one <br />sign <br />8.9 Billboards Along Interstates 85 and 40 <br />Billboards within one hundred (100) feet of the right -of -way along these principal roads <br />are prohibited, with the exception of existing billboards located there on the date of <br />adoption. These pre - existing billboards shall be subject to the following restrictions: <br />a) shall not be enlarged or expanded, <br />b) a signed statement with the name and address of the owner and current leasee for <br />each sign shall be kept on file with the Zoning Officer, <br />C) shall be subject to yearly inspections, <br />d) shall conform to the requirements set forth in G S 1:36 -126, et seq. <br />M. <br />
