Cloud Service Questionnaire <br />This questionnaire is to be used to assess security and legal issues <br />surrounding cloud services under consideration for Orange County. For this <br />questionnaire, cloud services are any services requiring storage of County <br />data outside the County network or provision of computing resources outside <br />of the County network. <br /> <br />Vendor under consideration: TMA Systems, LLC <br />Solution under consideration: WebTMA SaaS <br />Department(s) served: Click here to enter text. <br /> <br />1. Who owns the data created by County personnel using this service? <br />TMA Response: As it applies to TMA’s SaaS model (TMA hosted), upon termination of <br />the agreement and provided that the County is not in default of any term of the <br />Agreement, TMA shall provide the county with a copy of their data. If the county <br />requires the data in a format other than the format provided, additional fees may apply to <br />convert the data to the different format at the then current rate charged by TMA for <br />professional services. <br /> <br />2. Does the Cloud contractually allow the County to access and retrieve its data at the <br />County’s discretion? <br />TMA Response: Data may be exported to Excel via system reports and queries. Direct <br />access to the backend database is not provided. If a full backup copy of the data is <br />required, TMA is open to discussing this option and associated fees. <br /> <br />If No, Explain: Please see above statement. <br /> <br />3. Is the Cloud provider contractually obligated to dispose, return or retrieve data in the <br />event of contract termination? <br />TMA Response: Yes, in the manner described in our first response. Additional <br />information related to contractual obligations related to data has been included in the <br />TMA Systems Subscription Agreement. Upon such provision of data, is the Cloud provider obligated to specify data format and <br />all information necessary for data extraction? <br />TMA Response: Static data is made available in Excel format. Historical work order <br />information is available in a .bak file. If the county require a format other than the format <br />provided, additional fees may apply at standard rates. <br /> <br />If No, Explain: <br /> <br />5.
