<br />6) Neglect
<br />Neglect of an insured to use all reasonable
<br />means to save and preserve property from
<br />further damage at and after the time of
<br />"loss".
<br />7) Nuclear Hazard
<br />Nuclear reaction or radiation or radioactive
<br />contamination unless fire ensues, and then
<br />only for ensuing "loss".
<br />8) War
<br />a) War including undeclared or civil war;
<br />b) Warlike action by a military force, in-
<br />cluding action in hindering or defending
<br />against an actual or expected attack, by
<br />any government, sovereign, or other au-
<br />thority using military personnel or other
<br />agents; or
<br />c) Insurrection, rebellion, revolution,
<br />usurped power, or action taken by gov-
<br />ernmental authority in hindering or de-
<br />fending against any of these.
<br />With respect to any action that comes within
<br />the terms of this exclusion and involves nu-
<br />clear reaction or radiation or radioactive
<br />contamination, this War exclusion super-
<br />sedes the Nuclear Hazard exclusion.
<br />9) Water
<br />a) Flood, surface water, waves (including
<br />tidal water and tsunami), tides, tidal
<br />wave, or overflow of any body of water
<br />or spray from any of these, all whether
<br />or not driven by wind (including storm
<br />surge);
<br />b) Mudslide or mudflow;
<br />c) By water or sewage which backs up
<br />through sewers or drains or which en-
<br />ters into and overflows or is otherwise
<br />discharged from a sewer, drain, sump
<br />pump, sump pump well, or any other
<br />system designed to remove subsurface
<br />water which is drained from the founda-
<br />tion area;
<br />d) Water under the ground surface press-
<br />ing on, flowing, or seeping through:
<br />i. Foundations, walls, floors, or
<br />paved surfaces;
<br />ii. Sidewalks or driveways;
<br />iii. Basements, whether paved or
<br />not; or
<br />iv. Doors, windows, or other open-
<br />ings.
<br />e) Waterborne material carried or other-
<br />wise moved by any of the water referred
<br />to in Paragraphs 9)a), 9)c), or 9)d), or
<br />material carried or otherwise moved by
<br />mudslide or mudflow.
<br />This exclusion applies regardless of whether
<br />any of the above, in Paragraphs 9)a) through
<br />9)e), is caused by any act of nature or is oth-
<br />erwise caused. An example of a situation to
<br />which this exclusion applies is the situation
<br />where a dam levee, seawall, or other bound-
<br />ary or containment system fails in whole or
<br />in part, for any reason, to contain the water.
<br />But if Water, as described in 9)a) through
<br />9)e) results in fire, explosion, sprinkler leak-
<br />age, volcanic action, or building glass
<br />breakage, we will pay for the "loss" or dam-
<br />age caused by such perils.
<br />10) Weather
<br />Weather conditions, but only if weather
<br />conditions contribute in any way with a peril
<br />excluded in Exclusions, Paragraph 5. to
<br />produce "loss".
<br />b. We do not cover "loss" or damage resulting
<br />from:
<br />1) Criminal, Fraudulent, Or Dishonest Acts
<br />Dishonest or criminal acts (including theft)
<br />committed by you or any of your members
<br />of a limited liability company, or any of
<br />your employees (including temporary or
<br />leased employees), directors, officers, trus-
<br />tees, or authorized representatives:
<br />a) Acting alone or in collusion with other
<br />persons; or
<br />b) While performing services for you or
<br />otherwise.
<br />We will cover acts of destruction by your
<br />employees (including temporary or leased
<br />employees) but only for ensuing "loss" or
<br />damage, but there is no coverage for "loss"
<br />or damage by theft by your employees (in-
<br />cluding temporary or leased employees) or
<br />any person to whom you entrust property for
<br />any purpose, whether acting alone or in col-
<br />lusion with any other party.
<br />We will cover "loss" caused by dishonest
<br />acts by carriers or other bailees for hire.
<br />2) Deterioration or Contamination
<br />a) Deterioration or contamination;
