He said they wanted to focus on the areas that abut the Rogers <br /> 7 Road community. He said there are permitting concerns with the railroad and that it is in writing <br /> 8 that they cannot encroach. He said the design firm will call the NC Railroad and ask again as a <br /> 9 private entity. He said they need to pursue connectivity in the eastern area. He said <br /> 10 development is entirely focused on the western side of the property. He said any development <br /> 11 that happens near the railroad would be for road access. <br /> 12 Commissioner Fowler asked for clarification on what the designers will bring forward. <br /> 13 Cy Stober said Gensler's job will be to take all the feedback and determine common <br /> 14 themes and exceptional needs. He said they will look at what the needs are in the community <br /> 15 and the desired density. <br /> 16 Commissioner Fowler thanked Cy Stober for reducing the scope of work and thus the <br /> 17 cost of the contract. <br /> 18 Commissioner Portie-Ascott asked about the following information in the agenda <br /> 19 abstract: <br /> 20 "Gensler did request modifications to the standard allocation of risks within the <br /> 21 contract. Planning & Inspections Director Cy Stober negotiated terms deemed <br /> 22 acceptable but unburdens Gensler from certain delays, lowering its standard of <br /> 23 care, and making payments compulsory even if work is not achieved to the <br /> 24 County's satisfaction." <br /> 25 Cy Stober said the methods that they are moving forward with may have methods <br /> 26 different from staff's but the goals are the same. He said the deliverable is the plan. He said <br /> 27 there was a need to make sure that the consultant is paid for their work. <br /> 28 Commissioner Richards said she thought they needed access in the northern area of the <br /> 29 property. <br /> 30 Cy Stober said they will still look at placing roads in the eastern side of the property. He <br /> 31 said that it has been made clear to staff that Purefoy Drive will not be the sole access. He said <br /> 32 they will not pursue development of buildings in that area. <br /> 33 Commissioner Richards said the fee assumes 75 people participating. She asked what <br /> 34 is the acceptable number of people participating. She said she wants to make sure as many <br /> 35 people as possible participate. <br />
