Erosion Control/Stormwater Regulations <br />The applicant has indicated the project will conform to existing stormwater management (Section 6.14) and <br />erosion and sedimentation control (Section 6.15) regulations of the UDO. See Attachment 5. (Subject: <br />Summary of Findings Regarding Conformance with Orange County Unified Development Ordinance <br />(UDO) for Erosion and Sedimentation Control and Stormwater Management). <br /> <br />Land Use Buffers/Setbacks <br />North 40 feet building setbacks, Type D 50’ Land Use Buffer <br />South 20 feet building setback, Type D 50’ Land Use Buffer <br />East 20 feet building setback, Type D 50’ Land Use Buffer <br />West 20 feet building setback, Type D 50’ Land Use Buffer <br />Per Section 6.8.6 of the UDO, Type D Land Use Buffers are required along all parcel lines. The proposed <br />site plan identifies access and outdoor storage areas encroaching in the required buffer area which is not <br />in compliance with the UDO. <br /> <br />Environmental Assessment (EA) <br />The applicant has provided an Environmental Assessment (EA) application and supporting materials as <br />required in Section 6.16 of the UDO with their submittal. These materials have been shared with various <br />State agencies via the NC Department of Administration’s State Clearinghouse. Planning and DEAPR <br />Staff have jointly reviewed the materials and agree with a determination of “Finding of No Significant <br />Impact (FONSI)” as required in Section 2.25.1 (B) (5) of the UDO (Attachment 5). This determination <br />eliminates a requirement from the applicant to provide a more detailed Environmental Impact Statement <br />(EIS) process as outlined in Sections 2.25.2 and 6.16.4 of the UDO. <br /> <br /> <br />Proposed Conditions <br />Per NCGS 160D-703, imposed conditions and site-specific standards are limited to those that address <br />conformance of the development and use of the site to local government ordinances and adopted plans <br />or the impacts reasonably expected to be generated by the development or use of the site. Per Section <br />2.9.1 (F) (3) of the UDO, the following conditions are being proposed: <br />1. Project shall be completed as presented in approved site plan/application packet. <br />2. Allow for a reduction of the 100’ setback from the southern property line for outdoor storage of <br />wood chips, stumps and logs, branches and similar wood by-products resulting from tree cutting <br />operations. Outdoor storage shall not be less than 40 feet from the southern property line. <br />3. Allow for Planning Director to review and approve minor changes to the approved plan, per <br />Section 2.9.1(I) of the Orange County Unified Development Ordinance, specific to the location <br />and arrangement of development within the limits of disturbance and the proposed “activity area”. <br />The “activity area” shall be defined as the edge of gravel as shown on the provided conditional <br />zoning plan set. <br />Solid Waste <br />The applicant has indicated development within the project will conform to the Orange County Solid <br />Waste Management Ordinance (Attachment 5). <br />73
