Planning Director’s Recommendation: <br />The Planning Director recommends that the Planning Board: <br />1) Consider the matter for action; <br />2) Acknowledge that legally-sufficient public notice was given for the application and this <br />meeting, in accordance with State and Orange County laws; <br />3) Review the staff report (Attachment 2), featuring analyses of compliance with the <br />UDO, impact to the surrounding area, safety and efficiency of land use, and <br />consistency with the county’s adopted plans; <br />4) Allow for the applicant’s request by presentation of materials; <br />5) Allow for public comments; and <br />6) Prepare for the BOCC both <br />a. a Statement describing whether the application is Consistent (Attachment 6) <br />or Inconsistent (Attachment 7) with all applicable plans, including the adopted <br />2030 Comprehensive Plan; and <br />b. a recommendation on the application for the proposed zoning atlas <br />amendment ordinance (Attachment 8). <br /> <br />FINANCIAL IMPACT: This request has been reviewed by various County departments who <br />have determined that the approval of the request would not create the need for additional <br />funding for the provision of County services. Costs associated with advertising, including the <br />public hearing notice and mailings, are covered by the application fee. <br /> <br />RECOMMENDATION: The Planning Director recommends the Board: <br /> <br />1. Receive the rezoning application, <br />2. Deliberate on the proposal as desired, <br />3. Consider the Planning Director’s recommendation, and <br />4. Make a recommendation to the BOCC on either the Statement of Consistency <br />(Attachment 6) or Statement of Inconsistency (Attachment 7) and the proposed ordinance <br />(Attachment 8) in time for the March 7, 2024 BOCC meeting. <br />15
