9/2/2020 <br /> <br />32 93 00 PLANTS Page 7 of 17 <br />1.10 WARRANTY <br />A. Special Warranty: Installer agrees to repair or replace plantings and accessories that fail in <br />materials, workmanship, or growth within specified warranty period. <br />1. Failures include, but are not limited to, the following: <br />a. Death and unsatisfactory growth, except for defects resulting from abuse, lack of <br />adequate maintenance, or neglect by Owner, or incidents that are beyond <br />Contractor's control. <br />b. Structural failures including plantings falling, blowing over or settling out of plumb. <br />c. Faulty performance of tree stabilization, edgings, tree grates, or subdrainage. <br />d. Deterioration of metals, metal finishes, and other materials beyond normal <br />weathering. <br />2. Warranty Periods from Date of Planting Completion: <br />a. Trees and Shrubs: 12 months. <br />b. Landscape grading, groundcovers and other plants: 12 months <br />c. Annuals: 3 months. <br />3. Include the following remedial actions as a minimum: <br />a. Immediately remove dead plants and replace unless required to plant in the <br />succeeding planting season. <br />b. Replace plants that are more than 25 percent dead or in an unhealthy condition at <br />end of warranty period. <br />c. There will be no limitation on replacements of each plant except for losses or <br />replacements due to species intolerance of environmental conditions. <br />1) Contractor shall notify Landscape Architect in writing of any concerns related <br />to species intolerance of environmental conditions prior to purchase of plant <br />material; otherwise, purchased plant material will be accepted by Contractor <br />as tolerant of environmental conditions. Detrimental conditions shall be <br />corrected prior to installation of plant material and shall not be considered <br />grounds for warranty exclusion. <br />d. Provide extended warranty for period equal to original warranty period, for replaced <br />plant material. As required, continue extended warranty until leaf out to ensure <br />health of replaced material. Plants shall be deemed dead if leaf out does not occur <br />prior to end of spring. <br />4. All replacements shall be plants of the same kind as originally planted and shall be of size <br />equal to that attained by adjacent plants of the same kind at the time replacement is made. <br />They shall be furnished and planted as specified herein. <br />5. Removal and replacement shall be at no cost to the Owner. <br />1.11 MAINTENANCE SERVICE <br />A. Initial Maintenance Service for Trees and Shrubs: Provide maintenance by skilled employees of <br />Landscape Installer. Maintain as required in Part 3. Begin maintenance immediately after plants <br />are installed and continue until plantings are acceptably healthy and well established but for not <br />less than maintenance period below. <br />1. Maintenance Period: 12 months. The Maintenance Period will begin from the date of <br />Substantial Completion (Part 1.3) for the last phase of work.
