9/2/2020 <br /> <br /> 016000 - 3 <br />1.7 PRODUCT WARRANTIES <br />A. This section includes administrative and procedural requirements for warranties required by the <br />Contract Documents, including manufacturer's standard warranties on products and special <br />warranties. Manufacturer's disclaimers and limitations on product warranties do not relieve <br />Contractor of warranty on Work that incorporates products. Manufacturer's disclaimers and <br />limitations on product warranties do not relieve suppliers, manufacturers, and subcontractors <br />required to countersign special warranties with the Contractor. <br />B. Related Damages and Losses: When correcting failed or damaged warranted construction, <br />remove and replace construction that has been damaged as a result of such failure or must be <br />removed and replaced to provide access for correction of warranted construction. <br />C. Reinstatement of Warranty: When work covered by warranty has failed and been corrected by <br />replacement or rebuilding, reinstate warranty by written endorsement. Reinstated warranty shall <br />be equal to original warranty with equitable adjustment for depreciation. <br />D. Replacement Cost: Upon determination that Work covered by warranty has failed replace or <br />rebuild Work to an acceptable condition complying with requirements of Contract Documents. <br />Contractor is responsible for cost of replacing or rebuilding defective Work regardless of whether <br />Owner has benefited from use of Work through portion of its anticipated useful service life. <br />E. Owner's Recourse: Expressed warranties made to Owner are in addition to implied warranties, <br />and shall not limit duties, obligations, rights and remedies otherwise available under law. <br />Expressed warranty periods shall not be interpreted as limitations on the time in which the Owner <br />can enforce such other duties, obligations, rights, or remedies. <br />F. Rejection of Warranties: Owner reserves the right to reject warranties and to limit selection to <br />products with warranties not in conflict with the requirements of Contract Documents. <br />G. Submit written warranties to the Architect prior to date certified for Final Payment. If Architect's <br />Certificate of Final Payment designates commencement date for warranties other than date of <br />Final Payment for Work, or designated portion of Work, submit written warranties upon request <br />of the Architect. <br />H. Form of Submittal: At Final Completion compile each required warranty properly executed by <br />Contractor, or by Contractor, subcontractor, supplier, or manufacturer. Organize warranty <br />documents into an orderly sequence based on table of contents of Project Manual. Bind warranties <br />and bonds in PDF format and submit digitally. <br />1.
