Correct me if I ' m wrong , they can 't deny Hillsborough water if they have a school on site , or 836 is that an option ? I just wanted to make sure I understand state law on that particular item . 837 838 Patrick Byker: State law as I understand it, requires an allocation to be made for the school based on what is projected . 839 That' s what the Town of Hillsborough ' s attorney . . . . this is in the staff report as well . . . reservation of an allocation does not, 840 if I recall , according to the letter, is not a commitment to serve . 841 842 Chris Johnston : Just so I understand , you said that you don ' t need Hillsborough water or sewer, because that seems to 843 be the main contention from the Town of Hillsborough , is that they are required to provide water and sewer, so if you are 844 saying that that is not a requirement, is that actually accurate or is that . . . . . 845 846 Patrick Byker : Let me back up just a bit . . . the water and wastewater are really zoning issues , those are issues that we 847 deal with as part of the engineering of the site and what we would evaluate , if we are fortunate enough for this to be 848 approved by the Board of County Commissioners , there is a . . . . map in your staff report that evaluates exactly how it 849 should be done with well and septic . 850 851 Charity Kirk : I ' m curious about a direct answer to the question . I don 't feel like you are being direct. 852 853 Chris Johnston : What I am hearing you say is that the site doesn ' t require water or sewer from Hillsborough given the 854 needs that you mentioned , by right, the area could support up to 35 , 000 . . . . 855 856 Jim Parker: The site has sufficient septic soils to support beyond 12 , 000 gallons a day , so the school does not need 857 public water/sewer but, it is a long term maintenance issue with septic and community wells . So , it is a primary desire to 858 have public water/sewer because it is not a long -term maintenance issue for the school . If we proceed with the rezoning , 859 it is important to know that it is not necessary to have water/sewer from the Town of Hillsborough although we would 860 seek it and proceed with that . . . . 861 862 Chris Johnston : You say seek it but really, it' s required by law in the State of North Carolina to provide it . . . 863 864 Jim Parker: It is , if we ask for it and desire it to go that direction . The purpose of the statement is in the decision . I don ' t 865 want the fact that you think or the mayor says that we need water/sewer they are not going to allow it . I don ' t want that to 866 change your decision . The point is , the schools can be supported by the soils that are on site , and by the water that 867 would be provided by wells as well as the ball fields and the tennis court . The recreational component may be 1 , 000 868 gallons a day . The school would be 12 , 000 gallons a day . 869 870 Chris Johnston : This comes back to the point of contention that I understand which is the providing of water and sewer. I 871 don ' t know 160D very well as far as requiring the Town to provide the water and sewer, my question is , is that a 872 stipulation where you are saying your site can provide water and sewer without needing the town ' s? 873 874 Jim Parker: Yes , that is exactly what I ' m saying . 875 876 Chris Johnston : Do you have the ability to waive that then in regards to if you were requesting ? 877
