<br />(D) statutes, ordinances, regulations or laws regarding or relating to unsolicited marketing activities,
<br />including but not limited to Telephone Consumer Protection Act of 1991 (TCPA) and Controlling
<br />the Assault of Non-Solicited Pornography and Marketing Act of 2003 (CAN-SPAM Act);
<br />(E) the Americans with Disabilities Act of 1990 (ADA); or
<br />(F) the Fair Credit Reporting Act (FCRA);
<br />(G) statutes, ordinances, regulations or laws regarding or relating to antitrust violations, restraint of
<br />trade, price fixing, or unfair competition (except as provided in the Media Liability insuring
<br />agreement), including but not limited to the Sherman Antitrust Act, the Clayton Act, the Robinson-
<br />Patman Act;
<br />and including (i) any rules or regulations promulgated thereunder, and (ii) any similar statutes, ordinances
<br />or regulations.
<br />Pollution
<br />or in any way involving any discharge, dispersal, seepage, migration, release or escape of any:
<br />(A) solid, liquid, gaseous, biological, radiological or thermal irritant, hazardous substance or
<br />contaminant, including but not limited to asbestos or asbestos products, smoke, fibers, mold,
<br />spores, fungi, germs, vapor, dust, soot, fumes, acids, alkalis, chemicals, radiation and waste.
<br />Waste includes but is not limited to materials to be recycled, reconditioned or reclaimed, and
<br />nuclear materials;
<br />(B) electromagnetism, or electromagnetic energy, radiation, or fields or force; or nuclear or other
<br />radiation.
<br />Prior Claims and Knowledge
<br />any fact, event, or circumstance, likely to give rise to a Claim or Loss of which a member of Management
<br />was aware (including claims, incidents or circumstances noticed under other insurance), or after reasonable
<br />inquiry should have been aware, prior to the Continuity Date.
<br />Trade Secrets and Intellectual Property
<br />any actual or alleged theft, misappropriation, plagiarism, misuse, or infringement of any rights with respect
<br />to patents, patent licenses, or the registration of patents.
<br />Government Actions
<br />a Claim brought by or on behalf of any state, federal, local or foreign governmental entity, in such entity’s
<br />regulatory or official capacity; but this exclusion will not apply to the Regulatory Fines & Penalties insuring
<br />agreement.
<br />Trading
<br />any actual or alleged trading losses, trading liabilities or change in value of accounts; any loss, transfer or
<br />theft of monies, securities or tangible property of the Insured or others; or the monetary value of any
<br />transactions or electronic fund transfers by or on behalf of the Insured which is lost, diminished, or damaged
