D. <br />E. <br />ONLINE strongly endorses the letter and spirit of the Federal Fair Credit Reporting Act.  ONLINE believes that <br />this law and similar state laws recognize and preserve the delicate balance between the rights of the consumer <br />and the legitimate needs of commerce. <br />In addition to the Federal Fair Credit Reporting Act, other federal and state laws addressing such topics as <br />computer crime and unauthorized access to protected databases have also been enacted.  As a prospective <br />user of consumer reports, ONLINE expects that Subscriber will comply with all relevant federal statutes and the <br />statutes and regulations of the states in which Subscriber operates. The FCRA provides that any person who <br />knowingly and willfully obtains information on a consumer from a consumer reporting agency under false <br />pretenses shall be fined under Title 18 of the United States Code, or imprisoned not more than two years, or <br />both. <br />8.Gramm Leach Bliley Act Requirements <br />A. <br />B. <br />C. <br />Subscriber hereby certifies and warrants that it will request and use the fraud prevention portion of the Service <br />in compliance with a “permitted purpose” under the Gramm Leach Bliley Act,(GLB) specifically fraud prevention <br />and detection. <br />Subscriber further agrees to limit its use of this portion of the Service to fraud prevention and detection. <br />Subscriber hereby certifies and warrants that it understands all obligations under the Gramm Leach Bliley Act, to <br />include 15 U.S.C. 6802 § 502 (e)(3)(B) and 16 C.F.R. § 314.4. <br />9. <br />10. <br />11. <br />Comprehensive Information Security Program. Subscriber hereby certifies that Subscriber shall implement and <br />maintain a comprehensive information security program written in one or more readily accessible parts and that <br />contains administrative, technical, and physical safeguards that are appropriate to the Subscriber ’s size and <br />complexity, the nature and scope of its activities, and the sensitivity of the information provided to the Subscriber by <br />ONLINE; and that such safeguards shall include the elements set forth in 16 C.F.R. § 314.4 and shall be reasonably <br />designed to (i) insure the security and confidentiality of the information provided by ONLINE, (ii) protect against any <br />anticipated threats or hazards to the security or integrity of such information, and (iii) protect against unauthorized <br />access to or use of such information that could result in substantial harm or inconvenience to any consumer. <br />Access Security. Subscriber acknowledges that it has received and reviewed a copy of the “ONLINE's Security <br />Requirements.” (See Exhibit E.) <br />A.
