+1EZ 9D : 053 `1 ( 6 lJja :3 <br /> Attachment 1 <br /> NORTH CAROLINA <br /> CONTRACT AMENDMENT # 1 <br /> ORANGE COUNTY <br /> THIS CONTRACT AMENDMENT ("Amendment") is made and entered into this llth day of September, 2023 by and <br /> between ORANGE COUNTY (hereinafter referred to as " County") and Clarion Associates , LLC (hereinafter referred <br /> to as "Provider" ) , <br /> WITNESSETH : <br /> THAT WHEREAS , the County and Provider entered into a contract dated May 22 , 2023 , (hereinafter the " Original <br /> Agreement") , for the provision of services for developing a Comprehensive Land Use Plan; and <br /> WIMREAS , the County and Provider desire to amend the Original Agreement while keeping in effect all terms and <br /> conditions of the Original Agreement not inconsistent with the terms and conditions set forth below . <br /> NOW THEREFORE, for and in consideration of the mutual covenants and agreements made herein, the parties agree to <br /> amend the Original Agreement as follows : <br /> 1 . "Attachment A : Deliverable and Fee Schedule" shall be replaced in its entirety with "Attachment A2 First <br /> Update to Deliverable and Fee Schedule" . <br /> 2 . The compensation for the additional work included in this Amendment shall be twenty three thousand seven <br /> hundred fifty dollars ( $23 , 750) . Article 5 of the Original Agreement is amended to reflect a maximum <br /> payable notAo - exceed amount of two hundred eleven thousand nine hundred fifty four dollars ( $211 , 954) . <br /> 3 . Except for the changes made herein, the Original Agreement shall remain in full force and effect to the extent <br /> it is not inconsistent with this Amendment .
