She considered the seventh guiding principle, "Promotion of 2 Economic Prosperity and Diversity," and read the definition: 3 "Development of a diversity of new businesses and expansion of existing 4 businesses should occur in Orange County." 5 She said there is no proposed economic development plan for this parcel and the potential owners 6 would be non-profits and not contribute to the tax base. She considered the eighth guiding 7 principle, "Preservation of Community Character," and read the definition: 8 "Future growth and development should occur in a manner that preserves and 9 enhances the existing character of the county, its townships, and rural crossroads 10 communities." 11 She said that the proposed uses are not consistent with the character of the community. She 12 said private recreation facilities do little to promote public health, safety, and general welfare. She 13 said the proposal doesn't fit in with the surrounding area. She said they cannot consider that 14 HYAA would be the specific owner. She said the request is not a walkable small mixed residential 15 proposal. She said that the proposed rezoning is inconsistent, not reasonable, and not in the 16 public interest and that the current zoning is appropriate. 17 18 A motion was made by Commissioner Richards and seconded by Commissioner Hamilton 19 to excuse Vice-Chair McKee from voting on the request. 20 21 VOTE: UNANIMOUS 22 23 A motion was made by Commissioner Greene to approve the Statement Of Inconsistency 24 of a Proposed Zoning Atlas Map Amendment with the Adopted Orange County 2030 25 Comprehensive Plan and Other Applicable Adopted Plans in the agenda packet as attachment 8, 26 as stated in subsection c that is not reasonable with the comprehensive plan Commissioner 27 Fowler seconded and clarified moving entire attachment 8 in the agenda packet. 28 Chair Bedford read the Statement of Inconsistency, attachment 8,from the agenda packet: 29 "The Board of County Commissioners hereby finds: 30 a. The requirements of Section 2.8 Zoning Atlas and Unified Development 31 Ordinance Amendments of the UDO have been deemed complete; and, 32 b. Pursuant to Sections 1.1.5 Statement of Intent - Amendments, and 1.1.7 33 Conformance with Adopted Plans of the UDO and to Section 160D-604(d) 34 Planning Board review and comment — Plan Consistency and 160D-605(a) 35 Governing Board Statement — Plan Consistency of the North Carolina General 36 Statutes, the Board finds that the amendment is inconsistent with the following 37 Land Use Objectives of the adopted 2030 Comprehensive Plan: 38 1) 3.1: Discourage urban sprawl, encourage a separation of urban and rural land 39 uses, and direct new development into areas where necessary community 40 facilities and services exist through periodic updates to the Land Use Plan. 41 The property is zoned Rural Residential and upzoning would introduce an 42 intensive non-residential use to a residential area that does not have 43 supporting public infrastructure. 44 2) 3.2: Coordinate land use patterns to facilitate the expanded use of nonauto 45 modes of travel, the increased occupancy of automobiles, and the 46 development and use of an energy-efficient transportation system.
