1 <br /> ORANGE COUNTY <br /> NORTH CAROLINA <br /> MEMORANDUM <br /> TO: Board of County Commissioners <br /> Bonnie Hammersley, Orange County Manager <br /> Travis Myren, Orange County Deputy Manager <br /> FROM: Cy Stober, Planning & Inspections Director <br /> CC: Patrick Mallett, Deputy Director, Development Services <br /> DATE: September 5, 2023 <br /> SUBJECT: Approved Borrow Pit and Dirt/Rock Stockpile for NC Department of <br /> Transportation 1-40 Highway Widening Project (NC DOT Project I- <br /> 3306A) <br /> On June 6, 2023, the Planning and Inspections Department received applications, plans, and supporting <br /> documents from Lane Construction Corporation (the NC DOT project contractor) to obtain <br /> administrative approvals for: <br /> 1. Non-residential Site Plan Zoning Compliance Permit (Case # SPR23-0002); <br /> 2. Land Disturbing Permit (Case # LDP23-042); and <br /> 3. Stream Buffer Authorization Certificate (Case # BAC23-0002). <br /> These plans and permits specifically request a borrow pit and dirt/rock stockpile area (approximately <br /> 14-acres with a stockpile capacity of up to 300,000 cubic yards)for structural and non-structural dirt/rock <br /> within a 206-acre parcel (Orange County PIN 9872-33-1584) (see attached map for location). The <br /> parcel is currently owned by Hanson Aggregates Southeast Inc.; zoned Rural Buffer (RB); and located <br /> at the northwest quadrant of the 1-40 West Interchange with New Hope Road (Exit 263). This borrow <br /> pit/rock stockpile supports all the structural/non-structural dirt/rock needs for the Orange County <br /> portions of NC DOT 1-40 Highway Widening Project (NC DOT Project 1-3306A). With the above <br /> approvals, the borrow pit and stockpiles use is permitted by the Orange County Unified Development <br /> (UDO Section 5.2 Table of Permitted Uses) as a permissible "by right" uses. <br /> The requests were reviewed by Orange County Staff and considered by the Development Advisory <br /> Committee (DAC) on June 15, 2023. The Orange County plan approvals and permits were <br /> subsequently issued on June 22, 2023. Other Federal and State permits and approvals were obtained <br /> by July 31, 2023.
