The property owner shall conduct a Traffic Impact Analysis (TIA) five (5) years after the <br /> 2 opening of the school and submit the TIA to Orange County Planning and Inspections <br /> 3 Department; <br /> 4 4. All handicapped parking spaces shall be installed with striped hashmarks to provide <br /> 5 additional separation between vehicles; <br /> 6 5. Subject to approval by the NCDOT, the property owner shall install a concrete median <br /> 7 along with additional striping on Lawrence Road at the intersection with Old NC 10 <br /> 8 Highway prior to issuance of a certificate of compliance for the school; <br /> 9 6. Subject to approval by the North Carolina Department of Transportation, the property <br /> 10 owner shall install school zone/35 m.p.h. speed limit signage on Lawrence Road and US <br /> 11 70A in the vicinity of the school; <br /> 12 7. Subject to approval by the Town of Hillsborough and the North Carolina Department of <br /> 13 Environmental Quality, in the event water service is provided to the school, the property <br /> 14 owner shall install fire hydrants at required intervals along US 70A prior to issuance of a <br /> 15 certificate of compliance for the school. <br /> 16 <br /> 17 Following the Planning Board's formal recommendation of denial for this application at the May <br /> 18 3, 2023 regular meeting, the applicant amended the list of offered conditions to include the <br /> 19 following two (2) conditions: <br /> 20 <br /> 21 1. There will be no cafeteria facilities if the site is served by an on-site septic system; and <br /> 22 2. For a minimum of six months after approval of this zoning atlas amendment, the applicant <br /> 23 shall not submit any site plan application for approximately 12 acres designated for a <br /> 24 school use within PIN 9883-19-4355, and during those six months the applicant shall grant <br /> 25 the Orange County School District an exclusive right to negotiate the purchase or lease of <br /> 26 approximately 12 acres for use as a K-8 school. <br /> 27 <br /> 28 Development of the property shall be permitted only through the review and approval of a future <br /> 29 site plan application(s) in accordance with Section 2.5, 2.18, and 2.19, respectively, of the UDO. <br /> 30 This is so staff can verify all imposed conditions are adhered to and allow for final review by <br /> 31 members of the Development Advisory Committee (DAC) as detailed within Section 1.9 of the <br /> 32 LIDO. The applicant is proposing to serve the schools with water and sewer service from the Town <br /> 33 of Hillsborough, as the Town is required to reserve capacity for an approved school by NCGS <br /> 34 115C-5210). One school has an approved charter. However, as shown in two documents in <br /> 35 Attachment 1, the "Reconnaissance Soil and Site Evaluation" and the letter from Wood Soil <br /> 36 Consultants, the onsite septic drain fields have been evaluated to accommodate the needs of a <br /> 37 total daily wastewater use of 12,000 gallons per day, reflecting a population of 1,200 students and <br /> 38 presuming no cafeteria will be a part of school operations. <br /> 39 <br /> 40 Public Notifications: In accordance with Section 2.8.7 of the LIDO, notices of the Public Hearing <br /> 41 were mailed via first class mail to property owners within 1,000 feet of the subject parcel. These <br /> 42 notices were mailed on May 22, 2023, 15 days before the hearing. Staff also posted the subject <br /> 43 parcel with a sign [or signs] on May 22, 2023, 15 days before the hearing. See Attachment 3 for <br /> 44 the notification materials. <br /> 45 <br /> 46 Planning Board Recommendation: The Planning Board reviewed the zoning atlas amendment at <br /> 47 its April 5, 2023 regular meeting with deliberations of this item continuing at a Special Meeting on <br /> 48 April 19, 2023 and a formal recommendation occurring at its May 3, 2023 regular meeting. At the <br /> 49 April 19 meeting, the Board voted 5-5 on a motion to recommend approval of the application with <br /> 50 the seven (7) additional conditions, which are detailed above. The Board was not able to achieve <br /> 51 a majority vote to make a recommendation to the BOCC at its April 19 meeting. <br />
