~9 <br />NORTH CAROLINA <br />ORANGE COIINTY <br />RESOLIITION OF THE ORANGE COUNTY BOARD OF EDUCATION <br />WHEREAS, the Orange County Board of Education holds an option <br />to purchase a certain tract or parcel of land owned by the H. C. <br />Euliss Trust described in the memorandum of that option recorded in <br />Book 3192 at Page 335 of the Orange County Registry; <br />AND, WHEREAS, the Orange County Board of Education has <br />determined that the property under said option will not be <br />necessary fox the middle school that the Orange County Board of <br />Education proposes to build on adjacent property; <br />AND, WHEREAS, Orange County has indicated an interest in <br />perhaps purchasing said property pursuant to the option for <br />puzposes other than a middle school and has requested that the <br />Orange County Board of Education assign its option rights to the <br />Orange County Board of County Commissioners; <br />SE IT RESOLVED, the Orange County Board of Education does <br />hereby assign the option to purchase a certain tract or parce;L of <br />land owned by the H, C. Euliss Trust pursuant to an opi;ion <br />agreement between the Orange County Board of Education and thc: H, <br />C. Euliss Trust dated September 10, 2003 to Orange County; <br />FVRTHER, BE IT RESOLVED, the Chair and the Secretary of the <br />Orange county Board of Education are hereby authorized and direc=ted <br />to execute such documentation as, in the opinion of counsel., may be <br />necessary for the assignment of the said option to Orange Cotuity. <br />This resolution adopted by action of the Orange County <br />Board of Education at its meeting o March 1., 2004, <br />S rle Carraway <br />Secretary <br />Orange County Board of Education <br />sgmt\ceD, 11 <br />
