Attachment 5 <br /> Resolution # RES-2023- 044 <br /> - <br /> ORANGE COUNTY BOARD OF COUNTY COMMISSIONERS <br /> A RESOLUTION OF INTENT TO ABANDON A FUTURE STREET RIGHT - OF -WAY <br /> AT ACORN RIDGE TRAIL <br /> WHEREAS , a +/- 0 . 36 area east of PIN 0806 - 34 - 5908 was designated as a Future Street <br /> on the subdivision plat for Phase III of Grand Oak Estates ; and <br /> WHEREAS , the future right- of-way was deeded to Orange County on April 19 , 1993 ; and <br /> WHEREAS , a roadway has not been constructed on the right- of-way , nor is construction <br /> of a roadway planned ; and <br /> WHEREAS , an application from the neighboring property owner requesting abandonment <br /> of the future right- of-way has been received so that correction of drainage issues can be <br /> accomplished by the property owner . <br /> NOW , THEREFORE , BE IT RESOLVED that Orange County intends to abandon the <br /> aforementioned right- of-way and hereby authorizes scheduling of the public hearing <br /> required by NCGS § 153A- 241 for September 5 , 2023 . <br /> Upon motion of Commissioner seconded by Commissioner <br /> the foregoing resolution was adopted this the ( day of <br /> 2023 . <br /> I , Laura Jensen , Clerk to the Board of Commissioners for the County of Orange , North <br /> Carolina , DO HEREBY CERTIFY that the foregoing is a true copy of so much of the <br /> proceedings of said Board at a meeting held on June 6 , 2023 , as relates in any way to <br /> the adoption of the foregoing and that said proceedings are recorded in the minutes of <br /> said Board . <br /> WITNESS my hand and the seal of said County , this ko day of J , 2023 . <br /> III eff# <br /> VN a <br /> Clerk to the Boa d of Commissioners <br /> (jf L <br /> 4"x` r- esrtscY <br />
