Access to Records. The following access to records requirements apply to this contract: <br /> <br />a. The RECIPIENT/SUBGRANTEE agrees to provide State, the FEMA Administrator, the <br />Comptroller General of the United States, or any of their authorized representatives access <br />to any books, documents, papers, and records of the RECIPIENT/SUBGRANTEE which <br />are directly pertinent to this contract for the purposes of making audits, exa minations, <br />excerpts, and transcriptions. <br /> <br />b. The RECIPIENT/SUBGRANTEE agrees to permit any of the foregoing parties to reproduce <br />by any means whatsoever or to copy excerpts and transcriptions as reasonably needed. <br /> <br />c. The RECIPIENT/SUBGRANTEE agrees to provide the FEMA Administrator or his <br />authorized representative access to construction or other work sites pertaining to the work <br />being completed under the contract. <br /> <br />d. In compliance with the Disaster Recovery Act of 2018, State and the <br />RECIPIENT/SUBGRANTEE acknowledge and agree that no language in this contract is <br />intended to prohibit audits or internal reviews by the FEMA Administrator or the Comptroller <br />General of the United States. <br /> <br />e. RECIPIENT/SUBGRANTEE agrees to allow the departments and agencies of the State of <br />North Carolina, FEMA, the Comptroller General of the United States, and any of their duly <br />authorized representatives access to any books, documents, papers, and records of <br />RECIPIENT/SUBGRANTEE which are directly pertinent to the NCEM Program for the <br />purpose of making audits, examinations, excerpts, and transcriptions . <br /> <br />14. Records Retention. All records required to be kept on the project shall be maintained for at <br />least five (5) years after final payments and until all other pending matter s under the grant for <br />this project have been closed. However, if any audit, litigation or other action arising out of or <br />related in any way to this project is commenced before the end of the five (5) year period, the <br />records shall be retained for one (1) year after all issues arising out of the action are finally <br />resolved or until the end of the five (5) year period, whichever is later. <br /> <br />15. Energy Efficiency. All participants in the projects funded hereby shall recognize mandatory <br />standards and policies relating to energy efficiency, which are contained in the state energy <br />conservation plan issued in compliance with the Energy Policy and Conservation Act (PL 94 - <br />163). <br /> <br />16. Personnel. RECIPIENT/SUBGRANTEE represents that it has, or will secure at its own <br />expense, all personnel required in performing the work under this Contract. Such personnel <br />shall not be employees of or have any contractual relationship with State. All of the work <br />required hereunder will be performed by RECIPIENT/SUBGRANTEE or under its supervision, <br />and all personnel engaged in the work shall be fully qualified and shall be authorized or <br />permitted under State and State law to perform such work.
