_____________________________________________________________________________ <br />State Centric MOA 4393-0083-F Orange County <br /> <br />22 <br /> <br />(contract, loan, insurance, guarantee); refrain from extending any further assistance to <br />the applicant under the program with respect to which the failure or refund occurred until <br />satisfactory assurance of future compliance has been received from such applicant; and <br />refer the case to the Department of Justice for appropriate legal proceedings. <br /> <br />6. Anti-Discrimination. RECIPIENT/SUBGRANTEE will comply with the following clauses: Titles <br />VI and VII of the Civil Rights Act of 1964 (PL 88-352), and the regulations issued pursuant <br />thereto (prohibiting discrimination on the basis race, color, national origin and ensuring that <br />individuals are employed, and that employees are treated during employment, without regard <br />to their race, color, creed, national origin, sex, or age); Title IX of the Education Amendments <br />of 1972 (codified as amended at 20 U.S.C. § 1681 et seq.) (prohibiting discrimination on the <br />basis of sex); Titles I, II, III, IV, and V of the Americans with Disability Act of 1990 (prohibiting <br />discrimination on the basis of disability); Section 504 of the Rehabilitation Act of 1973 (codified <br />as amended at 29 U.S.C. § 794) (prohibiting discrimination on the basis of handicap); the Age <br />Discrimination Act of 1975 (codified as amended at 42 U.S.C. § 6101 et seq.) (prohibiting age <br />discrimination); Executive Order 11063 as amended by Executive Order 2259; and Section 109 <br />of the Housing and Community Development Act of 1974, as amended. <br /> <br />7. Contract Work Hours and Safety Standards Act (40 U.S.C. 3701-3708). <br /> <br />Compliance with the Contract Work Hours and Safety Standards Act. <br /> <br />a. Overtime requirements. No RECIPIENT/SUBGRANTEE or subcontractor contracting for <br />any part of the contract work which may require or involve the employment of laborers or <br />mechanics shall require or permit any such laborer or mechanic in any workweek in which <br />he or she is employed on such work to work in excess of forty hours in such workweek <br />unless such laborer or mechanic receives compensation at a rate not less than one and <br />one-half times the basic rate of pay for all hours worked in excess of forty hours in such <br />workweek. <br /> <br />b. Violation; liability for unpaid wages; liquidated damages. In the event of any violation of the <br />clause set forth in 29 CFR §5.5(b)(1), the RECIPIENT/SUBGRANTEE and any <br />subcontractor responsible therefor shall be liable for the unpaid wages. In addition, such <br />RECIPIENT/SUBGRANTEE and subcontractor shall be liable to the United States (in the <br />case of work done under contract for the District of Columbia or a territory, to such District <br />or to such territory), for liquidated damages. Such liquidated damages shall be computed <br />with respect to each individual laborer or mechanic, including watchmen and guards, <br />employed in violation of the clause set forth in 29 CFR §5.5(b)(1), in the sum of $26 for each <br />calendar day on which such individual was required or permitted to work in excess of the <br />standard workweek of forty hours without payment of the overtime wages required by the <br />clause set forth in 29 CFR §5.5(b)(1). <br /> <br />c. Withholding for unpaid wages and liquidated damages . State shall upon its own action or <br />upon written request of an authorized representative of the Department of Labor withhold <br />or cause to be withheld, from any moneys payable on account of work performed by the <br />RECIPIENT/SUBGRANTEE or subcontractor under any such contract or any other Federal <br />contract with the same prime RECIPIENT/SUBGRANTEE, or any other federally-assisted <br />contract subject to the Contract Work Hours and Safety Standards Act, which is held by the <br />same prime RECIPIENT/SUBGRANTEE, such sums as may be determined to be <br />necessary to satisfy any liabilities of such RECIPIENT/SUBGRANTEE or subcontractor for <br />DocuSign Envelope ID: 9080716C-121D-4F19-9E12-FB2684335DF5DocuSign Envelope ID: A02EDAA0-6072-4731-9C1B-857DF9D747A3
