What are the 50 dwelling units that are walkable? 1269 <br /> 1270 <br />Cy Stober: Again, as I mentioned before, we have addressed more than 50 units in a 1,000-foot radius for notification so 1271 <br />that addresses that requirement. We requested that sidewalks be placed upon the public road network and the DOT said 1272 <br />no. So, we’ve gone to the limit that we have to try to realize this as a walkable community and the regulatory agency at 1273 <br />the DOT will not allow it to become a walkable community. 1274 <br /> 1275 <br />Chris Johnston: Is the failure of that in our consideration or is that based on the site plan… 1276 <br /> 1277 <br />Cy Stober: Staff analysis is that the application is consistent with the COCA as described on the slide. My analysis, staff analysis, is that the allocation is consistent with this description and the 1279 <br />central Orange coordinator for a mixed residential neighborhood. 1280 <br /> 1281 <br />Charity Kirk: Did you have any discussion with Hillsborough before bringing this to us, to address their concerns? Or 1282 <br />because it’s already in the COCA and that was the law, we can’t address their …for their plans and desires. 1283 <br /> 1284 <br />Cy Stober: I think that there is correspondence from staff, Tom King, Brian Green, and their stormwater manager in your 1285 <br />packet. We are required to provide a courtesy review by COCA and we did that. The plans were revised through the plan 1286 <br />review element. There are some outstanding comments with regard to water and sewer but the stormwater comments 1287 <br />and many of the planning comments were addressed through that process and that can be found in your packet. So 1288 <br />these were provided to the Town of Hillsborough. With regard to their comprehensive plan of consistency, staff did not 1289 <br />mention any consistency concerns. 1290 <br /> 1291 <br />Charity Kirk: What is the likelihood that this will be annexed into Hillsborough? 1292 <br /> 1293 <br />Cy Stober: Annexation in North Carolina now is almost exclusively voluntary. So, it would have to be voluntary from the 1294 <br />property owners. The town would have to consent to that annexation request. 1295 <br /> 1296 <br />Lamar Proctor: So it will become a non-contiguous part of Hillsborough if they hook up to the water and sewer? 1297 <br /> 1298 <br />Cy Stober: They would be out of town, they would not be a satellite incorporated area, no it would not be in the town 1299 <br />limits. It would stay in Orange County and pay out of town rates for water and sewer pending utility expansion. 1300 <br /> 1301 <br />Lamar Proctor: I’m just confused because I know that there is voluntary annexation agreements, so my experience is 1302 <br />with noncontiguous parcels and that became part of Mebane and it was voluntary…. 1303 <br /> 1304 <br />Cy Stober: Hillsborough historically has not had the policy that the city of Mebane has that they require a petition for 1305 <br />annexation with a utility connection request. Mebane does require that by policy. I believe Hillsborough either just 1306 <br />recently adopted a similar policy or is in the process of incorporating that into their standards. But they have not had that 1307 <br />requirement. 1308 <br /> 1309 <br />Melissa Poole: Is HYAA represented here? Or tennis? Understanding the resident’s concerns regarding lighting and 1310 <br />such and the fact that there are not going to be fences. Generally speaking, how long do you anticipate nightly for the 1311 <br />lights to be on? 1312 <br /> 1313 <br />Tennis representative: I don’t have an answer to that. I don’t know what the UDO statute is, I know that we would be 1314 <br />compliant with that. Typically tennis court lights in other cities and towns go off at either 9 or 10 pm and I anticipate ours 1315 <br />to be at a similar time because night time is night time. The intention is to have directional lighting that points down on 1316 <br />the courts. There are LED lights and if you’ve ever seen the public courts in Mebane, those lights point directly down on 1317 <br />the court and they do a really good job of not spreading. They are not pointed out straight ahead so they aren’t going to 1318 <br />28
