We’re not entitled to ask until there is a charter approved for the k-8. 1160 <br /> 1161 <br />Lamar Proctor: But, what we are approving is two schools. We have to assume that you are going to get the charters 1162 <br />and that they are going to be fully built out and that you are going to have 1400 students. 1163 <br /> 1164 <br />Patrick Byker: It could be a private school, for instance. Correct me if I’m wrong director, in the UDO there is no 1165 <br />distinction between private schools and charter schools or public schools 1166 <br /> 1167 <br />Cy Stober: So, similar to our discussion about the retail store at White Cross last month, you cannot make a decision 1168 <br />based upon the tenants. So yes, there is no distinction between schools, it’s a school. 1169 <br /> 1170 <br />Lamar Proctor: For our purposes, a school is a school is a school. I did also want to clarify in the packet, page 267, it 1171 <br />mentions an endangered species, a proposed endangered species, the tri-colored bat. Your packet said it anticipates it 1172 <br />will go on the endangered species list, prior to construction. So, you’ll have to deal with that issue, that’s correct, right? 1173 <br /> 1174 <br />Patrick Byker: Absolutely. As of today, what happens in the future is to be determined. 1175 <br /> 1176 <br />Lamar Proctor: I just wanted to clarify, because it seems like it’s going to happen. 1177 <br /> 1178 <br />Patrick Byker: This is something that our team has had to deal with on numerous sites across the Piedmont area of 1179 <br />North Carolina. 1180 <br /> 1181 <br />Lamar Proctor: It’s a minor point, I just wanted to clarify that. I think Mr. Watson asked about the town’s concern with 1182 <br />insufficient flow. There was also concern about a mixed sewer/septic system. 1183 <br /> 1184 <br />Jim Parker: The insufficient flow will be fixed with the addition of water tanks if necessary. I don’t really know what the 1185 <br />concern about mixed sewer/septic means. You have many lots across the street that have a combination of public water 1186 <br />and conventional septic systems on their lots so, it is not uncommon to have water service and septic system. I don’t 1187 <br />know what that comment really means. 1188 <br /> 1189 <br />Lamar Proctor: Hillsborough would be legally obligated to provide water and sewer and then you would pursue that 1190 <br />because that is your right under North Carolina law. 1191 <br /> 1192 <br />Jim Parker: I want to make sure that it is understood by the board, if Hillsborough provides water and sewer, the cost of 1193 <br />providing that and all of the water and sewer lines would not be borne by the town. 1194 <br /> 1195 <br />Charity Kirk: I am concerned about Hillsborough not wanting this project. Have you addressed any of their concerns 1196 <br />since they unanimously said no to the project and since we last met 2 weeks ago? 1197 <br /> 1198 <br />Patrick Byker: We evaluated how to build the project with well and septic in order to move forward without needing town 1199 <br />utilities which I assume would address their concerns. 1200 <br /> 1201 <br />Charity Kirk: But you are not telling them that you don’t want their water if you are going to use the state law to get their 1202 <br />water it sounds like. So that doesn’t sound like you have addressed their concerns… 1203 <br /> 1204 <br />Patrick Byker: I don’t mean to speak for the Town of Hillsborough’s attorney but there is a letter in the packet that 1205 <br />states….so we are operating today on the premise that as of 10:01 April 19, we may well have to proceed using well and 1206 <br />septic… 1207 <br />1208 <br />26
