Chris Johnston: Do you have the ability to waive that then in regards to if you were requesting? 879
880
Patrick Byker: I have worked with this team for 10 or 15 years and we have done these charter schools on well and 881
septic in rural communities across central North Carolina so this is not new to us. We can pursue well and septic or if 882
Hillsborough refuses to serve it…. 883
884
Chris Johnston: Is that even an option? 885
886
Jim Parker: We will either do it with well and septic or we will do it with public water/sewer. It’s not really a zoning 887
question. 888
889
Charity Kirk: Cy, can we specify that this property cannot use City of Hillsborough Water? 890
891
Cy Stober: You cannot. This is a land use matter and in addition to considering land, there is this additional limitation on 892
your considerations with regard to related traffic ….usually that would be something you could consider. You can 893
consider the land use and its impacts to the surrounding area. I would add, when it comes to well and septic, should it be 894
pursued, any septic drain fields that would then be significantly added on to or removed, would require a public hearing. 895
896
Charity Kirk: But we can’t make an amendment… 897
898
Cy Stober: No, you cannot. 899
900
Charity Kirk: So it’s a moot point. 901
902
Cy Stober: Correct. 903
904
Steve Kaufmann: If you were to use septic on that site, would it infringe on any of the ballfields in terms of needing that 905
property for septic? 906
907
Jim Parker: You have your package of soil analysis of the whole site and I think there is 8 acres that has been stipulated 908
that the school could be supported by. The ballfields on the school property, could be used as a septic innovative system 909
to absorb that. On each parcel if you note there are areas indicated for ….septic fields, so each parcel could have a 910
shared septic field from the entire development. There is more than enough acreage there for that. 911
912
Charity Kirk: Again, we can’t make any judgement on the septic system, right? Or say that we want something in that 913
regard…. 914
915
Cy Stober: Hillsborough Utilities cannot be the basis for a vote. 916
917
Charity Kirk: I understand that it can’t be the basis for a vote but can we stipulate that they…. 918
919
Cy Stober: No… 920
921
Charity Kirk: Okay, so we can’t do anything to say they have to use septic or they don’t have to use septic. We can’t say 922
that they need to have stormwater retention ponds or improved water… 923
924
Cy Stober: So we have evaluated all that and they have met our standards, if there are additional reasonable 925
considerations related to the land use, that could be something to negotiate a condition on but my point was simply that 926
the health standards of the county reviews have been reviewed as provided by the applicant and they have been 927
reviewed on site plans as well as ….the materials that are in your packet, so that potential shared system was evaluated 928
by staff and the health department. 929
930
Charity Kirk: But if the school wants city water, the school gets city water? 931
932
Cy Stober: That would be a determination between the Town and the school. 933
21
