9 <br /> Attachment 5 <br /> Resolution # RES-2023-044 <br /> ORANGE COUNTY BOARD OF COUNTY COMMISSIONERS <br /> A RESOLUTION OF INTENT TO ABANDON A FUTURE STREET RIGHT-OF-WAY <br /> AT ACORN RIDGE TRAIL <br /> WHEREAS, a +/- 0.36 area east of PIN 0806-34-5908 was designated as a Future Street <br /> on the subdivision plat for Phase III of Grand Oak Estates; and <br /> WHEREAS, the future right-of-way was deeded to Orange County on April 19, 1993; and <br /> WHEREAS, a roadway has not been constructed on the right-of-way, nor is construction <br /> of a roadway planned; and <br /> WHEREAS, an application from the neighboring property owner requesting abandonment <br /> of the future right-of-way has been received so that correction of drainage issues can be <br /> accomplished by the property owner. <br /> NOW, THEREFORE, BE IT RESOLVED that Orange County intends to abandon the <br /> aforementioned right-of-way and hereby authorizes scheduling of the public hearing <br /> required by NCGS § 153A-241 for September 5, 2023. <br /> Upon motion of Commissioner , seconded by Commissioner <br /> , the foregoing resolution was adopted this the day of <br /> 2023. <br /> I, Laura Jensen, Clerk to the Board of Commissioners for the County of Orange, North <br /> Carolina, DO HEREBY CERTIFY that the foregoing is a true copy of so much of the <br /> proceedings of said Board at a meeting held on June 6, 2023, as relates in any way to <br /> the adoption of the foregoing and that said proceedings are recorded in the minutes of <br /> said Board. <br /> WITNESS my hand and the seal of said County, this day of , 2023. <br /> SEAL <br /> Clerk to the Board of Commissioners <br />
