In advance of <br /> the MA22-0004 PB Hearing, we respectfully request that your department add the proffer below <br /> to your staff report for this agenda item. In accordance with N.C. Gen. Stat. § 160D-703(b) and <br /> Section 2.9.1(17)(3)(c) of the Orange County Unified Development Ordinance, the <br /> owner/applicant makes the following proffer to be adopted in connection with MA22-0004: <br /> "Within twenty-four(24) months after the issuance of a certificate of occupancy for the <br /> charter school that is a component of MA22-0004, and subject to the availability of adequate <br /> right of way, and subject to approval by the N.C. Department of Transportation(NCDOT) and <br /> any other necessary regulatory authorities, the applicant will construct southbound and <br /> northbound left-turn lanes, with appropriate storage and tapers, on Lawrence Road at the <br /> intersection of Lawrence Road and U.S. 70 (collectively,the"Lawrence Road-U.S. 70 Turn <br /> Lanes"), and prior to issuance of the aforementioned certificate of occupancy, the applicant will <br /> post a performance bond with NCDOT(the"NCDOT Bond")pursuant to applicable NCDOT <br /> bonding requirements, and shall include Orange County in a rider to the NCDOT Bond as well, <br /> to guarantee the construction the Lawrence Road-U.S. 70 Turn Lanes; <br /> OR <br />
