Small <br /> developments that provide only supportive non-residential land uses in an infill <br /> arrangement serving more than 50 dwelling units in a walkable manner may also <br /> be considered. <br /> The Recreational use will be public, though proposed for management by a non- <br /> profit organization that will prioritize use for its members; and the Care & <br /> Educational uses will be public charter schools, complying with State laws <br /> regarding their operation and student acceptance. The property is current a mixture <br /> of agriculture and undeveloped land that will be developed as a "supportive non- <br /> residential land use" in this area that is otherwise a built-out residential area. The <br /> uses are anticipated to serve hundreds of homes and is as walkable as allowed by <br /> the regulatory agencies — a sidewalk will align the private street, as required by <br /> Orange County; NCDOT will not allow sidewalk construction along its roads in the <br /> unincorporated area on the property perimeters. <br /> The amendment is consistent with these goals because the proposed development is <br /> consistent with existing/anticipated development within the area and the land use associated <br /> with the project is compatible with various 2030 Comprehensive Plan goals detailed above. <br /> d. The amendment is reasonable and in the public interest because <br /> 1) It furthers the goals of the adopted Comprehensive Plan and is located in an area <br /> designated on the Future Land Use Map as a "20 Year Transition Area" by <br /> providing a Recreational Use and two Care & Educational Facility Uses — <br /> recreational facilities and two charter schools— in a predominantly residential <br /> area of Orange County. Such Areas have been identified as land located in areas <br /> that are in the process of changing from rural to urban in form and density. The <br /> proposed uses will provide public amenities and resources to the surrounding <br /> residential community and greater region, which currently does not have ready <br /> access to either of the uses. The existing baseball and tennis facilities within <br /> reasonable proximity of the property will soon be extinguished by the <br /> redevelopment of those properties by the Collins Ridge subdivision in <br /> Hillsborough. (reference pages 5-15 and F-1 of the Comprehensive Plan, and <br /> page 10-62 of the UDO); and <br /> 2) It furthers the goal of the Town of Hillsborough-Orange County Central Orange <br /> Coordinated Area Land Use Plan to "...to determine the consistency of any <br /> proposed rezoning request with the Town and County future land use visions," <br /> and is consistent with the "Mixed Residential (Neighborhood)" Future Land Use <br /> Classification description provided therein. The Recreational use will be public <br /> and serve stated needs, particularly with recreational fields in the Town of <br /> Hillsborough being extinguished due to an unrelated residential development on <br /> those existing recreationally-used properties. The Care & Educational uses will <br /> be public charter schools, complying with State laws regarding their operation <br /> and student acceptance and serving established State interests in providing <br /> public charter schools as an educational option.
