The requested zoning district, MPD-CD (Master Plan Development- Conditional District), is <br /> consistent with the 2030 Comprehensive Plan, Appendix F, Relationships Between Land <br /> Use Classifications and Zoning Districts; and the Town of Hillsborough/Orange County <br /> Central Orange Coordinated Area (COCA) Land Use Plan. <br /> e. The 2030 Comprehensive Plan, Appendix G, Land Use Classification and Overlay <br /> Locational Criteria, identifies 20-Year Transition Areas as land designated in the <br /> Comprehensive Plan as being located in areas that are in the process of changing from <br /> rural to urban, that are suitable for urban-type densities and should be provided with public <br /> utilities and services within the second 10-year phase of the Comprehensive Plan. <br /> The proposed uses will introduce a more intensive land use that will serve public needs and <br /> purposes on a currently undeveloped property. Both the recreation facilities and schools will <br /> be open to the public, though managed by a non-profit organization and a charter school <br /> board(s), respectively. The schools are proposed to be served with Town water and sewer, <br /> as regulated by NCGS 115C-521(1). The site will have a private street internal to the <br /> property and all improvements to NCDOT roads are subject to NCDOT approval and <br /> regulation. NCDOT has prohibited the construction of sidewalks on its public road network <br /> due to the lack of an existing nearby or adjacent sidewalk network and the lack of a <br /> maintenance entity. <br /> 3. The Town of Hillsborough/Orange County COCA Land Use Plan identifies Mixed Residential <br /> Neighborhood areas as "[d]evelopments [that]... may integrate a variety of supportive commercial, <br /> public and semi-public uses and open or public space. Small developments that provide only <br /> supportive non-residential land uses in an infill arrangement serving more than 50 dwelling units in <br /> a walkable manner may also be considered." <br /> The Recreational use will be public, though proposed for management by a non-profit organization <br /> that will prioritize use for its members; and the Care & Educational uses will be public charter <br /> schools, complying with State laws regarding their operation and student acceptance. The property <br /> is current a mixture of agriculture and vacant land that will be developed as a "supportive non- <br /> residential land use" in this area that is otherwise a built-out residential area. The uses are <br /> anticipated to serve hundreds of homes and is as walkable as allowed by the regulatory agencies — <br /> a sidewalk will align the private street, as required by Orange County; NCDOT will not allow <br /> sidewalk construction along their roads in the unincorporated area on the property perimeters. <br /> 4. The applicant has provided a basic environmental assessment as part of this submittal. Staff has <br /> reviewed and made a Finding of No Significant environmental Impact is expected from this project <br /> based on existing conditions. <br /> The proposed development is consistent with existing/anticipated development within the area and the <br /> land use associated with the project is compatible with various 2030 Comprehensive Plan and Central <br /> Orange Coordinated Area goals detailed above. <br /> 14 <br />
